Article 38 (Preferential Payment of Wage Claims)
제38조 임금채권의 우선변제

임금, 재해보상금, 그 밖에 근로 관계로 인한 채권은 사용자의 총재산에 대하여 질권(質權)ㆍ저당권 또는 「동산ㆍ채권 등의 담보에 관한 법률」에 따른 담보권에 따라 담보된 채권 외에는 조세ㆍ공과금 및 다른 채권에 우선하여 변제되어야 한다. 다만, 질권ㆍ저당권 또는 「동산ㆍ채권 등의 담보에 관한 법률」에 따른 담보권에 우선하는 조세ㆍ공과금에 대하여는 그러하지 아니하다. <개정 2010.6.10>
Wages, compensation for industrial accidents, and other claims arising from the employment relationship shall be paid in preference to taxes, public charges, and other claims, except for claims secured by a pledge, mortgage, or security interest under the Act on Security Interests in Movable Property and Claims. However, this shall not apply to taxes and public charges that take precedence over a pledge, mortgage, or security interest under the Act on Security Interests in Movable Property and Claims. <Amended on June 10, 2010>
제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 채권은 사용자의 총재산에 대하여 질권ㆍ저당권 또는 「동산ㆍ채권 등의 담보에 관한 법률」에 따른 담보권에 따라 담보된 채권, 조세ㆍ공과금 및 다른 채권에 우선하여 변제되어야 한다. <개정 2010.6.10>
