최저임금은 근로자의 생계비, 유사 근로자의 임금, 노동생산성 및 소득분배율 등을 고려하여 정한다. 이 경우 사업의 종류별로 구분하여 정할 수 있다.
The minimum wage shall be determined by considering the cost of living for workers, wages of similar workers, labor productivity, and income distribution rates, etc. In this case, it may be determined by classifying it by type of business.
제1항에 따른 사업의 종류별 구분은 제12조에 따른 최저임금위원회의 심의를 거쳐 고용노동부장관이 정한다. <개정 2010.6.4>
The classification by type of business under paragraph ① shall be determined by the Minister of Employment and Labor after deliberation by the Minimum Wage Committee pursuant to Article 12. <Amended on June 4, 2010>
