제10조 임의가입자 등의 기준소득월액의 결정 및 적용기간

다음 각 호의 어느 하나에 해당하는 가입자(「국민기초생활 보장법」 제7조제1항제1호에 따른 생계급여 수급자 및 같은 항 제3호에 따른 의료급여 수급자는 제외한다. 이하 이 항에서 같다)의 기준소득월액은 매년 전년도 12월 31일 현재의 지역가입자 전원의 기준소득월액을 기준으로 그 중위수에 해당하는 자의 기준소득월액에 해당하는 금액으로 하되, 그 적용 기간은 해당 연도 4월부터 다음 연도 3월까지로 한다. 다만, 가입자 본인이 기준소득월액을 중위수에 해당하는 자의 기준소득월액보다 높게 결정하여 줄 것을 신청하는 경우에는 공단은 기준소득월액의 변경 결정을 할 수 있다. <개정 2010.7.1, 2015.12.22>

The standard earnings monthly amount for subscribers falling under any of the following subparagraphs (excluding recipients of livelihood benefits under Article 7 (1) 1 of the National Basic Living Security Act and recipients of medical benefits under the same subparagraph 3; hereinafter the same applies in this paragraph) shall be determined annually based on the standard earnings monthly amount of all regional subscribers as of December 31 of the previous year, at the amount corresponding to the standard earnings monthly amount of the median individual among them; provided, however, that the period of application shall be from April of the relevant year to March of the following year. In such cases, if a subscriber applies for the standard earnings monthly amount to be determined higher than the standard earnings monthly amount of the median individual, the Corporation may determine a change in the standard earnings monthly amount. <Amended by Act No. 10416, Jul. 1, 2010; Act No. 13688, Dec. 22, 2015> 1. 「국민기초생활 보장법」 제7조제1항제1호에 따른 생계급여 수급자 및 같은 항 제3호에 따른 의료급여 수급자가 제1항 각 호의 어느 하나에 해당하는 가입자가 되는 경우의 기준소득월액은 「국민기초생활 보장법」 제23조제1항에 따른 조사에서 확인된 소득 중 같은 법 시행령 제5조제1항제1호 및 제2호에 따른 소득을 합하여 계산한 금액(이하 "「국민기초생활 보장법」에 따른 수급자의 합산 소득"이라 한다)을 기준으로 결정하되, 그 적용 기간은 해당 연도 4월부터 다음 연도 3월까지로 한다. <개정 2011.12.8, 2015.12.22>

In cases where recipients of livelihood benefits under Article 7 (1) 1 of the National Basic Living Security Act and recipients of medical benefits under the same subparagraph 3 become subscribers falling under any of the subparagraphs of paragraph ①, the standard earnings monthly amount shall be determined based on the amount calculated by summing the income confirmed through the survey under Article 23 (1) of the National Basic Living Security Act and the income under Article 5 (1) 1 and 2 of the Enforcement Decree of the same Act (hereinafter referred to as "summed income of recipients under the National Basic Living Security Act"); provided, however, that the period of application shall be from April of the relevant year to March of the following year. <Amended by Act No. 11167, Dec. 8, 2011; Act No. 13688, Dec. 22, 2015>

제2항에도 불구하고 가입기간 중 「국민기초생활 보장법」에 따른 수급자의 합산 소득이 변경되어 가입자가 기준소득월액 변경을 신청하는 경우에는 신청한 날이 속하는 달의 다음 달부터 그 변경된 소득을 기초로 기준소득월액을 결정한다. <신설 2011.12.8>

Notwithstanding paragraph ②, if the summed income of recipients under the National Basic Living Security Act changes during the subscription period and the subscriber applies for a change in the standard earnings monthly amount, the standard earnings monthly amount shall be determined based on the changed income from the month following the month in which the application is filed. <Newly Added by Act No. 11167, Dec. 8, 2011>
