제10조 임의가입자 등의 기준소득월액의 결정 및 적용기간

다음 각 호의 어느 하나에 해당하는 가입자(「국민기초생활 보장법」 제7조제1항제1호에 따른 생계급여 수급자 및 같은 항 제3호에 따른 의료급여 수급자는 제외한다. 이하 이 항에서 같다)의 기준소득월액은 매년 전년도 12월 31일 현재의 지역가입자 전원의 기준소득월액을 기준으로 그 중위수에 해당하는 자의 기준소득월액에 해당하는 금액으로 하되, 그 적용 기간은 해당 연도 4월부터 다음 연도 3월까지로 한다. 다만, 가입자 본인이 기준소득월액을 중위수에 해당하는 자의 기준소득월액보다 높게 결정하여 줄 것을 신청하는 경우에는 공단은 기준소득월액의 변경 결정을 할 수 있다. <개정 2010.7.1, 2015.12.22>

The standard income amount for an insured person falling under any of the following subparagraphs (excluding a recipient of livelihood benefits under Article 7(1) of the 「National Basic Livelihood Security Act」 and a recipient of medical benefits under Article 7(3) of the same Act. This shall apply mutatis mutandis to this paragraph) shall be determined annually as an amount equivalent to the standard income amount of the person corresponding to the median value, based on the standard income amounts of all regional insured persons as of December 31 of the preceding year, and the application period shall be from April of the relevant year to March of the following year. 「국민기초생활 보장법」 제7조제1항제1호에 따른 생계급여 수급자 및 같은 항 제3호에 따른 의료급여 수급자가 제1항 각 호의 어느 하나에 해당하는 가입자가 되는 경우의 기준소득월액은 「국민기초생활 보장법」 제23조제1항에 따른 조사에서 확인된 소득 중 같은 법 시행령 제5조제1항제1호 및 제2호에 따른 소득을 합하여 계산한 금액(이하 "「국민기초생활 보장법」에 따른 수급자의 합산 소득"이라 한다)을 기준으로 결정하되, 그 적용 기간은 해당 연도 4월부터 다음 연도 3월까지로 한다. <개정 2011.12.8, 2015.12.22>
For insured persons who are recipients of livelihood benefits under Article 7(1) of the 「National Basic Livelihood Security Act」 and recipients of medical benefits under Article 7(3) of the same Act, and who become insured persons falling under any of the subparagraphs of paragraph ①, the standard income amount shall be determined based on the amount calculated by summing the income as specified in Article 5(1) 1 and 2 of the Enforcement Decree of the 「National Basic Livelihood Security Act」 among the income confirmed through the investigation under Article 23(1) of the 「National Basic Livelihood Security Act」 (hereinafter referred to as "summed income of recipients under the 「National Basic Livelihood Security Act」"), and the application period shall be from April of the relevant year to March of the following year. <Amended by Act No. 11920, Dec. 8, 2011; Act No. 13623, Dec. 22, 2015>
제2항에도 불구하고 가입기간 중 「국민기초생활 보장법」에 따른 수급자의 합산 소득이 변경되어 가입자가 기준소득월액 변경을 신청하는 경우에는 신청한 날이 속하는 달의 다음 달부터 그 변경된 소득을 기초로 기준소득월액을 결정한다. <신설 2011.12.8>
Notwithstanding paragraph ②, if the summed income of recipients under the 「National Basic Livelihood Security Act」 changes during the period of insurance coverage and the insured person applies for a change in the standard income amount, the standard income amount shall be determined based on the changed income from the month following the month in which the application was filed. <Newly Inserted by Act No. 11920, Dec. 8, 2011>
