법 제17조제4항에서 "대통령령으로 정하는 이자"란 기여금 및 부담금의 월별 납부 기한으로부터 10년이 지난 날이 속하는 달부터 기여금 및 부담금의 납부를 신청한 날이 속하는 달까지의 기간에 대해 미납된 기여금 및 부담금에 1년 만기 정기예금 이자율(이자의 계산기간 중에 그 이자율이 변동되거나 은행에 따라 이자율이 다른 경우에 적용할 이자율은 해당 연도마다 1월 1일 현재 「은행법」에 따라 설립된 은행 중 전국을 영업구역으로 하는 은행이 적용하는 이자율을 평균한 이자율로 한다. 이하 같다)을 곱하여 산정한 금액을 말한다.
The "interest prescribed by Presidential Decree" in Article 17 (4) of the Act refers to the amount calculated by multiplying the unpaid contributions and levies by the annual interest rate for one-year fixed deposits for the period from the month in which the 10th anniversary of the monthly due date of contributions and levies falls, to the month in which the date of application for payment of contributions and levies falls. (If such interest rate changes during the interest calculation period or if interest rates vary among banks, the interest rate to be applied shall be the average interest rate applied by banks established under the Banking Act as of January 1st of each year, which have the entire country as their business area. This shall be the same hereinafter.)
법 제17조제5항에서 "대통령령으로 정하는 이자"란 근로자가 기여금 및 부담금을 납부한 날의 다음 날부터 공단이 해당 근로자에게 기여금 및 부담금을 돌려주기로 결정한 날까지의 기간에 대해 돌려줄 기여금 및 부담금에 「국세기본법 시행령」 제43조의3제2항에 따른 국세환급가산금의 이자율을 곱하여 산정한 금액을 말한다.
The "interest prescribed by Presidential Decree" in Article 17 (5) of the Act refers to the amount calculated by multiplying the contributions and levies to be returned to the worker by the interest rate for tax refund surcharges under Article 43-3 (2) of the Enforcement Decree of the Framework Act on National Taxes, for the period from the day following the date on which the worker paid the contributions and levies, to the date on which the Corporation decides to return the contributions and levies to the worker.
「국민건강보험법」 제13조에 따른 국민건강보험공단(이하 "건강보험공단"이라 한다)은 법 제17조제3항 후단에 따라 기여금 및 부담금을 납부받은 경우 그 사실을 공단에 지체 없이 알려야 한다.
The National Health Insurance Service (hereinafter referred to as the "Health Insurance Service") under Article 13 of the National Health Insurance Act shall, upon receiving contributions and levies pursuant to the latter part of Article 17 (3) of the Act, promptly notify the Corporation of such fact.
