제24조의2 연금보험료 일부 납부 월의 가입기간 계산 등

공단은 가입자 또는 가입자였던 자가 노령연금을 청구하거나 그의 유족이 유족연금을 청구하는 경우에 연금보험료(지역가입자, 임의가입자, 임의계속가입자의 연금보험료에 한정한다. 이하 이 조에서 같다)가 일부 납부되어 있으면 맨 나중 월에 일부 납부된 연금보험료로 맨 처음 월의 연체금과 미납된 연금보험료부터 순차적으로 충당한다. 이 경우 충당 후 완납된 월을 가입기간에 산입할 때에는 완납된 월의 기준소득월액 및 연도별 재평가율을 적용한다.
The Corporation shall, when an insured person or a former insured person applies for an old-age pension or his/her survivor applies for a survivor pension, and pension insurance premiums (limited to pension insurance premiums of local insured persons, voluntary insured persons, and voluntary continuing insured persons; hereinafter the same applies in this Article) have been partially paid, first cover the arrears and unpaid pension insurance premiums from the earliest month using the partially paid pension insurance premiums in the latest month. In this case, when including months for which full payment has been made after coverage in the coverage period, the monthly income amount and the revaluation rates by year of the fully paid months shall apply.
공단이 법 제17조의2제2항 본문에 따라 일부 납부된 연금보험료를 반환할 경우 노령연금 또는 유족연금 수급권자에게 반환하되, 수급권자가 이를 반환받기 전에 사망한 경우에는 법 제55조에 따른 미지급급여 청구권자에게 반환한다.
When the Corporation refunds partially paid pension insurance premiums pursuant to the main clause of Article 17-2 (2) of the Act, it shall refund them to the recipient of an old-age pension or survivor pension; provided, that if the recipient dies before receiving the refund, they shall be refunded to the claimant for unpaid benefits under Article 55 of the Act.
가입자 또는 가입자였던 자가 법 제17조의2제2항 단서에 따른 청구를 한 경우에는 청구한 날이 속하는 달의 다음 달 10일까지 일부 납부된 월의 미납된 연금보험료와 연체금 및 제4항에 따른 이자를 공단에 납부하여야 한다. 이 경우 납부를 청구한 가입자 또는 가입자였던 자가 다음 각 호의 어느 하나에 해당하게 된 경우에는 공단은 일부 납부된 연금보험료를 반환한다.
1. 납부하기 전에 사망한 때
2. 노령연금을 받은 때
3. 납부기한까지 납부하지 아니한 때
When an insured person or a former insured person makes an application under the proviso of Article 17-2 (2) of the Act, he/she shall pay the unpaid pension insurance premiums and arrears for the months for which partial payment was made, and the interest under paragraph
법 제17조의2제3항에 따른 이자는 다음 각 호에서 정하는 기간의 개월 수를 기준으로 산정하며, 이자율은 해당기간의 1년 만기 정기예금 이자율로 한다. <개정 2021.11.30>
1. 일부 납부된 연금보험료를 반환하는 경우: 일부 납부한 날이 속하는 달의 다음 달부터 연금을 지급하여야 할 사유가 생긴 날이 속하는 달까지
2. 일부 납부된 월의 미납된 연금보험료를 납부받는 경우: 해당 월 연금보험료의 납부기한이 속하는 달의 다음 달부터 제3항에 따른 청구가 있는 날이 속하는 달까지

When refunding partially paid pension insurance premiums: From the month following the month in which the date of partial payment falls, until the month in which the reason for payment of the pension arises. 2. When receiving unpaid pension insurance premiums for months with partial payment: From the month following the month in which the payment deadline for the pension insurance premiums of the relevant month falls, until the month in which the application under paragraph ③ falls.
