제102조 기금의 관리 및 운용

기금은 보건복지부장관이 관리ㆍ운용한다. <개정 2008.2.29, 2010.1.18>

보건복지부장관은 국민연금 재정의 장기적인 안정을 유지하기 위하여 그 수익을 최대로 증대시킬 수 있도록 제103조에 따른 국민연금기금운용위원회에서 의결한 바에 따라 다음의 방법으로 기금을 관리ㆍ운용하되, 가입자, 가입자였던 자 및 수급권자의 복지증진을 위한 사업에 대한 투자는 국민연금 재정의 안정을 해치지 아니하는 범위에서 하여야 한다. 다만, 제2호의 경우에는 재정경제부장관 및 기획예산처장관과 협의하여 국채를 매입한다. <개정 2007.8.3, 2008.2.29, 2010.1.18, 2025.10.1>
1. 대통령령으로 정하는 금융기관에 대한 예입 또는 신탁
2. 공공사업을 위한 공공부문에 대한 투자
3. 「자본시장과 금융투자업에 관한 법률」 제4조에 따른 증권의 매매 및 대여
4. 「자본시장과 금융투자업에 관한 법률」 제5조제1항 각 호에 따른 지수 중 금융투자상품지수에 관한 파생상품시장에서의 거래
5. 제46조에 따른 복지사업 및 대여사업
6. 기금의 본래 사업 목적을 수행하기 위한 재산의 취득 및 처분
7. 그 밖에 기금의 증식을 위하여 대통령령으로 정하는 사업
In order to maintain the long-term stability of the National Pension finances and maximize its returns, the Minister of Health and Welfare shall manage and operate the fund in the following ways in accordance with the resolutions of the National Pension Fund Management Committee under Article 103: Provided, That investment in projects for the welfare promotion of subscribers, former subscribers, and beneficiaries shall be made within the scope that does not harm the stability of the National Pension finances. In cases falling under subparagraph 2, treasury bonds shall be purchased in consultation with the Minister of Strategy and Finance and the Minister of Planning and Budget. <Amended by Act No. 8575, Aug. 3, 2007; Act No. 9445, Feb. 29, 2008; Act No. 9931, Jan. 18, 2010; Act No. 17502, Oct. 1, 2025> 1. Deposit or trust in financial institutions prescribed by Presidential Decree. 2. Investment in the public sector for public projects. 3. Trading and lending of securities under Article 4 of the Capital Markets and Financial Investment Business Act. 4. Trading in the derivatives market concerning financial investment product indices among the indices referred to in each subparagraph of Article 5 (1) of the Capital Markets and Financial Investment Business Act. 5. Welfare projects and lending projects under Article 46. 6. Acquisition and disposal of assets for the performance of the original business purpose of the fund. 7. Other projects prescribed by Presidential Decree for the growth of the fund.
제2항제5호와 제6호에 따른 사업 외의 사업으로 기금을 관리ㆍ운용하는 경우에는 자산 종류별 시장수익률을 넘는 수익을 낼 수 있도록 신의를 지켜 성실하게 하여야 한다. 다만, 제2항제2호에 따라 기금을 「공공자금관리기금법」에 따른 공공자금관리기금(이하 "관리기금"이라 한다)에 예탁할 경우 그 수익률은 같은 법 제7조제2항에 따라 공공자금관리기금운용위원회가 5년 만기 국채 수익률 이상의 수준에서 대통령령으로 정하는 바에 따라 제103조에 따른 국민연금기금운용위원회와 협의하여 정한다.
When managing and operating the fund through projects other than those referred to in subparagraphs 2 and 6 of paragraph (2), it shall be carried out with good faith and diligence to generate returns exceeding the market rate of return by asset type: Provided, That when depositing the fund into the Public Capital Management Fund under the Public Capital Management Fund Act (hereinafter referred to as the "Management Fund") under subparagraph 2 of paragraph (2), the rate of return shall be determined in consultation with the National Pension Fund Management Committee under Article 103, at a level not less than the yield of 5-year treasury bonds, as prescribed by Presidential Decree, in accordance with Article 7 (2) of the same Act.
제2항제3호에 따라 기금을 관리ㆍ운용하는 경우에는 장기적이고 안정적인 수익 증대를 위하여 투자대상과 관련한 환경ㆍ사회ㆍ지배구조 등의 요소를 고려할 수 있다. <신설 2015.1.28>
When managing and operating the fund under subparagraph 3 of paragraph (2), factors such as environment, society, and governance related to the investment targets may be considered for long-term and stable return enhancement. <Newly Inserted by Act No. 13039, Jan. 28, 2015>
보건복지부장관은 기금의 운용 성과 및 재정 상태를 명확히 하기 위하여 대통령령으로 정하는 바에 따라 기금을 회계처리하여야 한다. <개정 2008.2.29, 2010.1.18, 2015.1.28>
