유족연금을 지급받을 수 있는 유족은 제72조제1항 각 호의 사람이 사망할 당시(「민법」 제27조제1항에 따른 실종선고를 받은 경우에는 실종기간의 개시 당시를, 같은 조 제2항에 따른 실종선고를 받은 경우에는 사망의 원인이 된 위난 발생 당시를 말한다) 그에 의하여 생계를 유지하고 있던 다음 각 호의 자로 한다. 이 경우 가입자 또는 가입자였던 자에 의하여 생계를 유지하고 있던 자에 관한 인정 기준은 대통령령으로 정한다. <개정 2011.12.31, 2016.5.29, 2023.6.13>

2. 자녀. 다만, 25세 미만이거나 제52조의2에 따른 장애상태에 있는 사람만 해당한다.
3. 부모(배우자의 부모를 포함한다. 이하 이 절에서 같다). 다만, 60세 이상이거나 제52조의2에 따른 장애상태에 있는 사람만 해당한다.
4. 손자녀. 다만, 19세 미만이거나 제52조의2에 따른 장애상태에 있는 사람만 해당한다.
5. 조부모(배우자의 조부모를 포함한다. 이하 이 절에서 같다). 다만, 60세 이상이거나 제52조의2에 따른 장애상태에 있는 사람만 해당한다.
Surviving dependents who can receive survivor's pension shall be those who were supported by the person referred to in each subparagraph of Article 72 (1) at the time of the person's death (in the case of a declaration of disappearance under Article 27 (1) of the Civil Act, the commencement of the period of disappearance; in the case of a declaration of disappearance under Article 27 (2) of the Civil Act, the occurrence of the disaster that caused death). The criteria for recognizing surviving dependents supported by the insured person or former insured person shall be determined by Presidential Decree. <Amended on Dec. 31, 2011, May 29, 2016, Jun. 13, 2023> 1. Spouse 2. Children. However, this applies only to those under 25 years of age or in a disabled state under Article 52-2. 3. Parents (including spouse's parents. The same shall apply hereinafter in this Section). However, this applies only to those aged 60 or older or in a disabled state under Article 52-2. 4. Grandchildren. However, this applies only to those under 19 years of age or in a disabled state under Article 52-2. 5. Grandparents (including spouse's grandparents. The same shall apply hereinafter in this Section). However, this applies only to those aged 60 or older or in a disabled state under Article 52-2.
유족연금은 제1항 각 호의 순위에 따라 최우선 순위자에게만 지급한다. 다만, 제1항제1호에 따른 유족의 수급권이 제75조제1항제1호 및 제2호에 따라 소멸되거나 제76조제1항 및 제2항에 따라 정지되면 제1항제2호에 따른 유족에게 지급한다. <개정 2011.12.31, 2021.12.21>
The survivor's pension shall be paid only to the person with the highest priority according to the order in each subparagraph of paragraph (1). However, if the right to receive benefits of a surviving dependent under subparagraph 1 of paragraph (1) is extinguished under subparagraphs 1 and 2 of Article 75 (1) or suspended under paragraphs (1) and (2) of Article 76, it shall be paid to the surviving dependent under subparagraph 2 of paragraph (1). <Amended on Dec. 31, 2011, Dec. 21, 2021>
제2항의 경우 같은 순위의 유족이 2명 이상이면 그 유족연금액을 똑같이 나누어 지급하되, 지급 방법은 대통령령으로 정한다.
In the case of paragraph (2), if there are two or more surviving dependents of the same priority, the survivor's pension amount shall be divided equally among them, and the method of payment shall be determined by Presidential Decree.
