사업의 종류, 근로자의 수 등을 고려하여 대통령령으로 정하는 사업장(이하 "당연적용사업장"이라 한다)의 18세 이상 60세 미만인 근로자와 사용자는 당연히 사업장가입자가 된다. 다만, 다음 각 호의 어느 하나에 해당하는 자는 제외한다. <개정 2009.2.6, 2018.3.20, 2019.12.10>
1. 「공무원연금법」, 「공무원 재해보상법」, 「사립학교교직원 연금법」 또는 「별정우체국법」에 따른 퇴직연금, 장해연금 또는 퇴직연금일시금이나 「군인연금법」에 따른 퇴역연금, 퇴역연금일시금, 「군인 재해보상법」에 따른 상이연금을 받을 권리를 얻은 자(이하 "퇴직연금등수급권자"라 한다). 다만, 퇴직연금등수급권자가 「국민연금과 직역연금의 연계에 관한 법률」 제8조에 따라 연계 신청을 한 경우에는 그러하지 아니하다.
2. 삭제<2011.6.7>
Employees and employers aged 18 or over and under 60 in workplaces prescribed by Presidential Decree considering the type of business, the number of employees, etc. (hereinafter referred to as "compulsorily applicable workplaces") shall automatically become workplace subscribers. Provided, that any person falling under any of the following subparagraphs shall be excluded. <Amended by Act No. 9444, Feb. 6, 2009; Act No. 15394, Mar. 20, 2018; Act No. 16860, Dec. 10, 2019> 1. Persons who have obtained the right to receive a retirement pension, disability pension, or lump-sum retirement pension under the Act on Public Officials Pension, the Act on Compensation for Disaster of Public Officials, the Act on the Pension for Faculty and Staff of Private Schools, or the Act on Special Post Offices, or a retirement pension or lump-sum retirement pension under the Act on Military Pensions, or a disability pension under the Act on Compensation for Disaster of Military Personnel (hereinafter referred to as "pension and other benefit recipients"). Provided, that this shall not apply to pension and other benefit recipients who have applied for linkage under Article 8 of the Act on the Linkage between National Pensions and Occupational Pensions. <Amended by Act No. 12785, Jun. 7, 2011> 2. 제1항 및 제6조에도 불구하고 국민연금에 가입된 사업장에 종사하는 18세 미만 근로자는 사업장가입자가 되는 것으로 본다. 다만, 본인이 원하지 아니하면 사업장가입자가 되지 아니할 수 있다. <개정 2015.1.28>
Notwithstanding paragraphs (1) and Article 6, employees under 18 years of age working in workplaces subscribed to the National Pension shall be deemed to become workplace subscribers. Provided, that they may not become workplace subscribers if they do not wish to do so. <Amended by Act No. 12263, Jan. 28, 2015>
제1항에도 불구하고 「국민기초생활 보장법」 제7조제1항제1호에 따른 생계급여 수급자 또는 같은 항 제3호에 따른 의료급여 수급자는 본인의 희망에 따라 사업장가입자가 되지 아니할 수 있다. <신설 2011.6.7, 2015.12.29>
Notwithstanding paragraph (1), recipients of livelihood benefits under Article 7 (1) 1 of the National Basic Livelihood Security Act or recipients of medical benefits under Article 7 (1) 3 of the same Act may not become workplace subscribers at their own request. <Newly Inserted by Act No. 12785, Jun. 7, 2011; Amended by Act No. 13730, Dec. 29, 2015>
