Article 16 (Request for Purchase of Land Subject to Disapproval Decision)
제16조 불허가처분 토지에 관한 매수 청구

제11조제1항에 따른 허가신청에 대하여 불허가처분을 받은 자는 그 통지를 받은 날부터 1개월 이내에 시장ㆍ군수 또는 구청장에게 해당 토지에 관한 권리의 매수를 청구할 수 있다.
A person who has received a disapproval decision regarding a permit application under Article 11 (1) may request the purchase of rights concerning the relevant land from the mayor, county governor, or district head within one month from the date of receiving the notification.
제1항에 따른 매수 청구를 받은 시장ㆍ군수 또는 구청장은 국가, 지방자치단체, 한국토지주택공사, 그 밖에 대통령령으로 정하는 공공기관 또는 공공단체 중에서 매수할 자를 지정하여, 매수할 자로 하여금 예산의 범위에서 공시지가를 기준으로 하여 해당 토지를 매수하게 하여야 한다. 다만, 토지거래계약 허가신청서에 적힌 가격이 공시지가보다 낮은 경우에는 허가신청서에 적힌 가격으로 매수할 수 있다.
The mayor, county governor, or district head who has received a purchase request under paragraph ① shall designate a buyer from among the State, local governments, the Korea Land and Housing Corporation, and other public institutions or public organizations prescribed by Presidential Decree, and shall have the designated buyer purchase the land within the scope of the budget based on the officially assessed land price. However, if the price written on the land transaction contract permit application is lower than the officially assessed land price, the land may be purchased at the price written on the application.
