Article 3-2 (Reporting of cancellation, etc. of real estate transactions)
제3조의2 부동산 거래의 해제등 신고

거래당사자는 제3조에 따라 신고한 후 해당 거래계약이 해제, 무효 또는 취소(이하 "해제등"이라 한다)된 경우 해제등이 확정된 날부터 30일 이내에 해당 신고관청에 공동으로 신고하여야 한다. 다만, 거래당사자 중 일방이 신고를 거부하는 경우에는 국토교통부령으로 정하는 바에 따라 단독으로 신고할 수 있다.
If a transaction contract reported under Article 3 is canceled, invalidated, or rescinded (hereinafter referred to as "cancellation, etc."), the transaction parties shall jointly report such cancellation, etc. to the competent reporting authority within 30 days from the date on which the cancellation, etc. becomes final. Provided, however, if one of the transaction parties refuses to report, the report may be filed individually as prescribed by the Ordinance of the Ministry of Land, Infrastructure and Transport.
개업공인중개사가 제3조제3항에 따라 신고를 한 경우에는 제1항에도 불구하고 개업공인중개사가 같은 항에 따른 신고(공동으로 중개를 한 경우에는 해당 개업공인중개사가 공동으로 신고하는 것을 말한다)를 할 수 있다. 다만, 개업공인중개사 중 일방이 신고를 거부한 경우에는 제1항 단서를 준용한다.
If a licensed real estate agent has filed a report under Article 3 (3), the licensed real estate agent may file the report referred to in the same paragraph (in cases of joint brokerage, this refers to joint reporting by the licensed real estate agents) notwithstanding paragraph ①. Provided, however, if one of the licensed real estate agents refuses to report, the proviso to paragraph ① shall apply mutatis mutandis.
제1항 및 제2항에 따른 신고의 절차와 그 밖에 필요한 사항은 국토교통부령으로 정한다.
The procedures for reporting under paragraphs ① and ②, and other necessary matters shall be prescribed by the Ordinance of the Ministry of Land, Infrastructure and Transport.
