Article 19 (Establishment of Defined Contribution Pension Plan)
제19조 확정기여형퇴직연금제도의 설정

확정기여형퇴직연금제도를 설정하려는 사용자는 제4조제3항 또는 제5조에 따라 근로자대표의 동의를 얻거나 의견을 들어 다음 각 호의 사항을 포함한 확정기여형퇴직연금규약을 작성하여 고용노동부장관에게 신고하여야 한다. <개정 2021.4.13, 2022.1.11>

2. 부담금의 산정 및 납입에 관한 사항
3. 적립금의 운용에 관한 사항
4. 적립금의 운용방법 및 정보의 제공 등에 관한 사항
4의2. 사전지정운용제도에 관한 사항
5. 적립금의 중도인출에 관한 사항
6. 제13조제1호부터 제3호까지 및 제6호부터 제10호까지의 사항
7. 그 밖에 확정기여형퇴직연금제도의 운영에 필요한 사항으로서 대통령령으로 정하는 사항
An employer intending to establish a defined contribution pension plan shall, after obtaining the consent or listening to the opinions of the employee representative in accordance with Article 4, Paragraph 3 or Article 5, prepare a defined contribution pension plan ordinance that includes the following matters and report it to the Minister of Employment and Labor. <Amended by Apr. 13, 2021, Jan. 11, 2022> 1. Matters concerning the contribution of contributions 2. Matters concerning the calculation and payment of contributions 3. Matters concerning the management of accumulated funds 4. Matters concerning the methods of managing accumulated funds and providing information, etc. 4.2. Matters concerning the pre-designated management system 5. Matters concerning the mid-term withdrawal of accumulated funds 6. Matters referred to in Article 13, subparagraphs 1 through 3 and 6 through 10 7. Other matters necessary for the operation of a defined contribution pension plan as prescribed by Presidential Decree
제1항에 따라 확정기여형퇴직연금제도를 설정하는 경우 가입기간에 관하여는 제14조를, 급여의 종류, 수급요건과 급여 지급의 절차ㆍ방법에 관하여는 제17조제1항, 제4항 및 제5항을, 운용현황의 통지에 관하여는 제18조를 준용한다. 이 경우 제14조제1항 중 "제13조제3호"는 "제19조제6호"로, 제17조제1항 중 "확정급여형퇴직연금제도"는 "확정기여형퇴직연금제도"로 본다.
When a defined contribution pension plan is established in accordance with Paragraph ①, Article 14 shall apply mutatis mutandis to the coverage period, Article 17, Paragraphs 1, 4, and 5 shall apply mutatis mutandis to the types of benefits, eligibility requirements, and the procedures and methods for payment of benefits, and Article 18 shall apply mutatis mutandis to the notification of management status. In this case, "Article 13, subparagraph 3" in Article 14, Paragraph 1 shall be deemed "Article 19, subparagraph 6", and "defined benefit pension plan" in Article 17, Paragraph 1 shall be deemed "defined contribution pension plan".
