①

운용관리업무를 수행하는 퇴직연금사업자는 사전지정운용방법에 다음 각 호 중 하나 이상의 운용유형을 포함하여 고용노동부장관의 승인을 받아야 한다.

1. 적립금의 원리금이 보장되는 운용유형
2. 「자본시장과 금융투자업에 관한 법률」 제229조에 따른 집합투자기구의 집합투자증권으로서 투자설명서상 다음 각 목의 어느 하나에 해당하는 운용내용이 운용계획에 명시되는 등 대통령령으로 정하는 요건을 충족하는 운용유형
1. 가. 투자목표시점이 사전에 결정되고 운용기간이 경과함에 따라 투자위험이 낮은 자산의 비중을 증가시키는 방향으로 자산배분을 변경하거나 위험수준을 조절하는 운용내용
2. 나. 투자위험이 상이한 다양한 자산에 분산투자하고 금융시장 상황 및 각 집합투자재산의 가치변동 등을 고려하여 주기적으로 자산배분을 조정함으로써 집합투자재산의 위험을 관리하고 장기 가치 상승을 추구하는 운용내용
3. 다. 단기금융상품 등에 투자하여 집합투자재산의 손실가능성을 최소화하고 단기 안정적인 수익을 추구하는 운용내용
4. 라. 「사회기반시설에 대한 민간투자법」 등 관련 법령에 따라 국가 및 지방자치단체가 추진하는 공공투자계획, 관련 사업 및 정책에 따른 사회기반시설사업 등에 투자하는 등 고용노동부령으로 정하는 요건을 충족하는 운용내용
5. 마. 그 밖에 대통령령으로 정하는 운용내용

A retirement pension provider performing operation management duties shall obtain approval from the Minister of Employment and Labor to include one or more of the following operation types in the pre-designated operation method. 1. Operation type where the principal and interest of the reserve fund are guaranteed 2. Operation type that satisfies the requirements prescribed by Presidential Decree, such as the operation details specified in the investment prospectus as falling under any of the following sub-items, as securities of collective investment facilities under Article 229 of the 「Capital Markets and Financial Investment Business Act」: a. Operation details where the investment target time is pre-determined, and asset allocation is changed or risk level is adjusted in a direction that increases the proportion of assets with low investment risk as the operation period progresses b. Operation details that manage the risk of collective investment property and pursue long-term value increase by diversifying investments in various assets with different investment risks and periodically adjusting asset allocation in consideration of financial market conditions and fluctuations in the value of each collective investment property c. Operation details that pursue short-term stable returns by investing in short-term financial instruments, etc., to minimize the possibility of loss of collective investment property d. Operation type that satisfies the requirements prescribed by the Minister of Employment and Labor, such as investing in social infrastructure projects according to public investment plans, related projects, and policies promoted by the State and local governments under relevant laws and regulations, including the 「Private Investment in Social Overhead Capital Act」 e. Other operation details prescribed by Presidential Decree

퇴직연금사업자가 제1항에 따라 고용노동부장관의 승인을 받고자 하는 경우 퇴직연금 관련 전문가로서 퇴직연금 및 자산운용에 관한 학식과 경험이 풍부하다고 인정되는 사람을 포함하는 등 고용노동부령으로 정하는 요건에 따라 구성된 고용노동부장관 소속 심의위원회의 사전심의를 받아야 한다.

When a retirement pension provider intends to obtain approval from the Minister of Employment and Labor pursuant to paragraph (1), it shall undergo prior deliberation by a deliberation committee under the Minister of Employment and Labor, which shall be composed according to the requirements prescribed by the Minister of Employment and Labor, including persons recognized as having extensive knowledge and experience in retirement pensions and asset management as retirement pension-related experts.

운용관리업무를 수행하는 퇴직연금사업자는 사전지정운용방법을 사용자에게 고용노동부령으로 정하는 방법에 따라 제시하여야 한다.

A retirement pension provider performing operation management duties shall present the pre-designated operation method to the employer in accordance with the method prescribed by the Minister of Employment and Labor.

제1항제2호에 따른 운용유형은 손실가능성과 예상수익이 중ㆍ장기적으로 합리적 균형을 이루고 수수료 등의 비용이 예상되는 수익에 비해 과다하여서는 아니 된다.

제3항에 따라 사전지정운용방법을 제시받은 사용자는 사업 또는 사업장 단위로 사전지정운용방법을 설정하여 근로자대표의 동의를 받아 확정기여형퇴직연금규약에 반영하여야 한다.

An employer who has been presented with the pre-designated operation method pursuant to paragraph (3) shall set the pre-designated operation method at the unit of business or workplace, obtain the consent of the labor representative, and reflect it in the rules of the defined contribution retirement pension plan.
