제23조의5 중소기업퇴직연금기금표준계약서의 기재사항 등

공단은 다음 각 호의 사항을 기재한 계약서(이하 "중소기업퇴직연금기금표준계약서"라 한다)를 작성하여 고용노동부장관의 승인을 받아야 한다.
1. 제13조제2호, 제3호, 제6호 및 제8호부터 제10호까지의 사항
2. 제19조제1항제1호부터 제3호까지 및 제5호의 사항
3. 제23조의3에 따른 중소기업퇴직연금기금의 관리ㆍ운용 업무에 관한 사항
4. 적립금 운용현황의 기록ㆍ보관ㆍ통지 업무에 관한 사항
5. 계좌의 설정 및 관리, 부담금의 수령, 적립금의 보관 및 관리, 급여의 지급 업무에 관한 사항
6. 그 밖에 중소기업퇴직연금기금제도의 운영을 위하여 대통령령으로 정하는 사항
The Corporation shall prepare a contract (hereinafter referred to as the "Standard Contract for the Pension Fund for Small and Medium Enterprises") stating the matters listed in the following subparagraphs, and obtain approval from the Minister of Employment and Labor. 1. Matters under Article 13, Subparagraphs 2, 3, 6, and 8 through 10 2. Matters under Article 19, Paragraph 1, Subparagraphs 1 through 3 and 5 3. Matters concerning the management and operation of the pension fund for small and medium enterprises under Article 23-3 4. Matters concerning the recording, storage, and notification of the status of fund operations 5. Matters concerning account establishment and management, receipt of contributions, storage and management of funds, and payment of benefits 6. Other matters prescribed by Presidential Decree for the operation of the pension fund system for small and medium enterprises
공단은 제1항에 따라 승인받은 중소기업퇴직연금기금표준계약서를 변경하는 경우에는 고용노동부장관의 승인을 받아야 한다. 다만, 변경하는 내용이 사용자 및 가입자에게 불리하지 아니한 경우에는 고용노동부장관에게 신고함으로써 중소기업퇴직연금기금표준계약서를 변경할 수 있다.
If the Corporation changes the Standard Contract for the Pension Fund for Small and Medium Enterprises approved under Paragraph ①, it shall obtain approval from the Minister of Employment and Labor. However, if the changed content is not disadvantageous to employers and subscribers, the Standard Contract for the Pension Fund for Small and Medium Enterprises may be changed by reporting to the Minister of Employment and Labor.
제1항 및 제2항에 따른 승인 또는 변경승인의 방법 및 절차 등에 필요한 사항은 대통령령으로 정한다.
Matters necessary for the method and procedures for approval or change approval under Paragraphs ① and ② shall be prescribed by Presidential Decree.
