제23조의7 부담금의 부담수준 및 납입 등

중소기업퇴직연금기금제도를 설정한 사용자는 매년 1회 이상 정기적으로 가입자의 연간 임금총액의 12분의 1 이상에 해당하는 부담금(이하 "사용자부담금"이라 한다)을 현금으로 가입자의 중소기업퇴직연금기금제도 계정(이하 "기금제도사용자부담금계정"이라 한다)에 납입하여야 한다. 이 경우 사용자가 정하여진 기일(중소기업퇴직연금기금표준계약서에서 납입 기일을 연장할 수 있도록 한 경우에는 그 연장된 기일을 말한다)까지 부담금을 납입하지 아니한 경우에는 그 다음 날부터 부담금을 납입한 날까지 지연 일수에 대하여 제20조제3항 후단에 따라 대통령령으로 정하는 이율에 따른 지연이자를 납입하여야 한다.
An employer who has established a Small and Medium-sized Enterprise Retirement Pension Fund System shall pay contributions equivalent to at least one-twelfth of the total annual wages of the participant on a regular basis at least once a year (hereinafter referred to as "employer contributions") in cash into the Small and Medium-sized Enterprise Retirement Pension Fund System account of the participant (hereinafter referred to as the "Fund System Employer Contribution Account"). In this case, if the employer fails to pay the contributions by the due date (referring to the extended due date if the due date is allowed to be extended in the Standard Contract for Small and Medium-sized Enterprise Retirement Pension Fund System), the employer shall pay delayed interest at a rate prescribed by Presidential Decree according to the latter part of Article 20 (3) for the number of days from the day after the due date until the date of payment.
사용자는 중소기업퇴직연금기금제도 가입자의 퇴직 등 대통령령으로 정하는 사유가 발생한 때에 그 가입자에 대한 부담금을 미납한 경우에는 그 사유가 발생한 날부터 14일 이내에 제1항에 따른 부담금과 지연이자를 해당 가입자의 기금제도사용자부담금계정에 납입하여야 한다. 다만, 특별한 사정이 있는 경우에는 당사자 간의 합의에 따라 납입 기일을 연장할 수 있다.
If an employer has failed to pay contributions for a participant of the Small and Medium-sized Enterprise Retirement Pension Fund System when a reason prescribed by Presidential Decree, such as retirement, occurs for that participant, the employer shall pay the contributions and delayed interest under Paragraph ① into the participant's Fund System Employer Contribution Account within 14 days from the date the reason occurred. However, if there are special circumstances, the payment due date may be extended by agreement between the parties.
제1항 및 제2항의 지연이자에 대한 적용제외 사유는 제20조제4항을 준용한다.
The grounds for exemption from the application of delayed interest under Paragraphs ① and ② shall apply mutatis mutandis to Article 20 (4).
그 밖에 사용자부담금의 납입 방법ㆍ절차 등에 필요한 사항은 대통령령으로 정한다.
Other matters necessary for the method and procedures of payment of employer contributions shall be prescribed by Presidential Decree.
