제28조 운용관리업무에 관한 계약의 체결

퇴직연금제도를 설정하려는 사용자 또는 가입자는 퇴직연금사업자와 다음 각 호의 업무(이하 "운용관리업무"라 한다)를 하는 것을 내용으로 하는 계약을 체결하여야 한다. 다만, 제1호의2의 업무는 확정기여형퇴직연금제도를 설정할 때에만 해당하고, 제2호의 업무는 확정급여형퇴직연금제도를 설정할 때에만 해당한다. <개정 2021.4.13, 2022.1.11>
1. 사용자 또는 가입자에 대한 적립금 운용방법 및 운용방법별 정보의 제공
1의2. 사전지정운용제도의 설정 및 운영에 관한 업무
2. 연금제도 설계 및 연금 회계처리
3. 적립금 운용현황의 기록ㆍ보관ㆍ통지
4. 사용자 또는 가입자가 선정한 운용방법을 제29조제1항에 따른 자산관리업무를 수행하는 퇴직연금사업자에게 전달하는 업무
5. 그 밖에 운용관리업무의 적절한 수행을 위하여 대통령령으로 정하는 업무
A user or subscriber intending to establish a retirement pension system shall conclude a contract with a retirement pension provider for the performance of the following business activities (hereinafter referred to as "operation and management business"). Provided, that the business activity under subparagraph 1-2 shall apply only when establishing a defined contribution retirement pension system, and the business activity under subparagraph 2 shall apply only when establishing a defined benefit retirement pension system. <Amended by Act No. 18012, Apr. 13, 2021; Act No. 18684, Jan. 11, 2022> 1. Providing information on methods for operating reserve funds and specific operating methods to users or subscribers. 1-2. Business related to the establishment and operation of a pre-designated operation system. 2. Pension system design and pension accounting. 3. Recording, storing, and notifying the status of reserve fund operation. 4. Business of transmitting the operating methods selected by the user or subscriber to a retirement pension provider performing asset management business under Article 29 (1). 5. Other business activities prescribed by Presidential Decree for the proper performance of operation and management business.
제1항에 따라 운용관리업무를 수행하는 퇴직연금사업자는 대통령령으로 정하는 일부 업무를 인적ㆍ물적 요건 등 대통령령으로 정하는 요건을 갖춘 자에게 처리하게 할 수 있다.
A retirement pension provider performing operation and management business pursuant to paragraph (1) may entrust the processing of some business activities prescribed by Presidential Decree to a person who meets the requirements prescribed by Presidential Decree, such as human and material requirements.
