Article 36 (Supervision of Retirement Pension Providers)
제36조 퇴직연금사업자에 대한 감독

고용노동부장관은 퇴직연금사업자가 이 법을 위반하는 행위를 한 경우에는 기간을 정하여 그 위반의 시정을 명할 수 있다.
The Minister of Employment and Labor may order a retirement pension provider to rectify any violation of this Act within a specified period.
고용노동부장관은 퇴직연금사업자가 제1항에 따른 시정명령에 따르지 아니하는 경우에는 이 법에 따라 수행하는 업무를 다른 퇴직연금사업자에게 이전할 것을 명할 수 있다.
If a retirement pension provider fails to comply with a rectification order under paragraph ①, the Minister of Employment and Labor may order the transfer of its duties performed under this Act to another retirement pension provider.
금융위원회는 퇴직연금제도의 안정적 운영과 근로자의 수급권 보호를 위하여 대통령령으로 정하는 업무에 관하여 퇴직연금사업자를 감독하고, 퇴직연금사업자가 제33조를 위반하는 경우 다음 각 호의 조치를 할 수 있다.
1. 퇴직연금사업자에 대한 주의, 그 임원에 대한 주의 또는 그 직원에 대한 주의ㆍ견책ㆍ감봉ㆍ정직ㆍ면직의 요구
2. 해당 위반행위에 대한 시정명령
3. 임원의 해임권고 또는 직무정지요구
4. 6개월 이내의 영업의 일부정지
The Financial Services Commission shall supervise retirement pension providers with regard to duties prescribed by Presidential Decree for the stable operation of the retirement pension system and the protection of workers' entitlement to benefits, and may take the following measures against a retirement pension provider that violates Article 33: 1. A demand for caution against the retirement pension provider, or caution, reprimand, salary reduction, suspension, or dismissal against its executives or employees. 2. An order to rectify the violation. 3. A recommendation for dismissal of an executive or a demand for suspension of duties. 4. A suspension of part of its business for a period not exceeding 6 months.
금융감독원장은 퇴직연금사업자의 업무 및 재산상황 등을 검사할 수 있고, 제33조제7항에 따라 퇴직연금사업자가 보고한 약관등이 이 법에 위배될 경우에는 변경ㆍ보완을 명할 수 있다.
The Governor of the Financial Supervisory Service may inspect the business and financial status of a retirement pension provider, and may order changes or supplementation if the terms and conditions reported by the retirement pension provider under Article 33 (7) violate this Act.
