제37조 금융거래정보의 제공 요청 등

고용노동부장관은 사용자가 제16조에 따른 급여 지급능력을 확보하였는지 등 퇴직연금제도 운영을 감독하기 위하여 필요한 경우 「금융실명거래 및 비밀보장에 관한 법률」 제4조 및 「신용정보의 이용 및 보호에 관한 법률」 제33조에도 불구하고 자산관리업무 및 운용관리업무 계약을 체결한 사업에 관한 다음 각 호의 금융거래에 관한 정보 또는 자료(이하 "금융거래정보"라 한다)의 제공을 퇴직연금사업자에게 요청할 수 있다.

The Minister of Employment and Labor may, when necessary for supervising the operation of the retirement pension system, such as securing the employer's ability to pay benefits under Article 16, request the retirement pension business operator to provide information or data concerning the following financial transactions related to the business that has concluded a contract for asset management and operation management, notwithstanding Article 4 of the Act on Real Name Financial Transactions and Confidentiality and Article 33 of the Act on the Use and Protection of Credit Information (hereinafter referred to as "Financial Transaction Information"). 1. Status of subscribers 2. Status of benefit payments 3. Status of contribution payments 4. Information on the status of reserve fund management
고용노동부장관이 제1항에 따라 금융거래정보를 요청할 때에는 다음 각 호의 사항을 적은 문서로 요청하여야 한다.

2. 요청의 법적 근거
3. 사용목적
4. 요청하는 금융거래정보의 내용
When the Minister of Employment and Labor requests Financial Transaction Information under paragraph ①, the request shall be made in writing stating the following matters. 1. The period of transactions subject to the request 2. The legal basis for the request 3. The purpose of use 4. The content of the Financial Transaction Information requested
제1항에 따른 금융거래정보의 요청은 퇴직연금제도 운영의 건전성 감독을 위하여 필요한 최소한도에 그쳐야 한다.
The request for Financial Transaction Information under paragraph ① shall be limited to the minimum extent necessary for supervising the sound operation of the retirement pension system.
제2항에 따라 퇴직연금사업자가 고용노동부장관에게 금융거래정보를 제공하는 경우에는 그 퇴직연금사업자는 금융거래정보를 제공한 날부터 10일 이내에 제공한 금융거래정보의 주요 내용, 사용목적, 제공받은 자 및 제공일자 등을 해당 사용자 또는 가입자에게 서면으로 알려야 한다. 이 경우 통지에 드는 비용에 관하여는 「금융실명거래 및 비밀보장에 관한 법률」 제4조의2제4항을 준용한다.
When a retirement pension business operator provides Financial Transaction Information to the Minister of Employment and Labor under paragraph ②, the retirement pension business operator shall, within 10 days from the date of providing the information, notify the employer or subscriber in writing of the main details of the provided Financial Transaction Information, the purpose of use, the recipient, and the date of provision. In this case, Article 4, Paragraph 4 of the Act on Real Name Financial Transactions and Confidentiality shall apply mutatis mutandis to the costs incurred for notification.
고용노동부장관은 제1항에 따라 퇴직연금사업자에게 금융거래정보를 요구하는 경우에는 그 사실을 기록하여야 하며, 금융거래정보를 요구한 날부터 5년간 그 기록을 보관하여야 한다.
When the Minister of Employment and Labor requests Financial Transaction Information from a retirement pension business operator under paragraph ①, the Minister shall record the fact of the request and retain the record for 5 years from the date of the request.
제1항에 따라 금융거래정보를 제공받아 알게 된 자는 그 알게 된 금융거래정보를 타인에게 제공 또는 누설하거나 그 목적 외의 용도로 이용하여서는 아니 된다.
Any person who obtains and becomes aware of Financial Transaction Information by receiving it under paragraph ① shall not provide or disclose such Financial Transaction Information to others or use it for any purpose other than the specified purpose.
