Article 38 (Treatment upon Abolition or Suspension of Retirement Pension System)
제38조 퇴직연금제도의 폐지ㆍ중단 시의 처리

퇴직연금제도가 폐지되거나 운영이 중단된 경우에는 폐지된 이후 또는 중단된 기간에 대하여는 제8조제1항에 따른 퇴직금제도를 적용한다.
When the retirement pension system is abolished or its operation is suspended, the retirement allowance system under Article 8, Paragraph 1 shall apply to the period after abolition or during suspension.
사용자는 퇴직연금제도가 폐지된 경우 지체 없이 적립금으로 급여를 지급하는 데에 필요한 조치로서 미납 부담금의 납입 등 대통령령으로 정하는 조치를 하여야 한다.
When the retirement pension system is abolished, the employer shall, without delay, take necessary measures for the payment of benefits with the reserves, such as payment of unpaid contributions, as prescribed by Presidential Decree.
사용자와 퇴직연금사업자는 제35조제2항에 따른 사유 등으로 퇴직연금제도가 중단된 경우에 적립금 운용에 필요한 업무 등 대통령령으로 정하는 기본적인 업무를 유지하여야 한다.
When the retirement pension system is suspended for reasons specified in Article 35, Paragraph 2, etc., the employer and the retirement pension provider shall maintain basic tasks prescribed by Presidential Decree, such as tasks necessary for the operation of reserves.
사용자와 퇴직연금사업자는 퇴직연금제도가 폐지되어 가입자에게 급여를 지급하는 경우에 가입자가 지정한 개인형퇴직연금제도의 계정으로 이전하는 방법으로 지급하여야 한다. 다만, 가입자가 개인형퇴직연금제도의 계정을 지정하지 아니한 경우에는 제17조제5항을 준용한다.
When the retirement pension system is abolished and benefits are paid to the subscribers, the employer and the retirement pension provider shall pay them by transferring them to the account of the individual retirement pension system designated by the subscriber. However, if the subscriber has not designated an account for the individual retirement pension system, Article 17, Paragraph 5 shall apply mutatis mutandis.
가입자가 제4항에 따라 급여를 받은 경우에는 제8조제2항에 따라 중간정산되어 받은 것으로 본다. 이 경우 중간정산 대상기간의 산정 등에 필요한 사항은 대통령령으로 정한다.
