제48조 과태료

다음 각 호의 어느 하나에 해당하는 자에게는 1천만원 이하의 과태료를 부과한다. <개정 2021.4.13>
1. 제16조제2항을 위반하여 적립금이 최소적립금을 넘고 있는지 확인하여 그 결과를 사용자에게 알리지 아니하거나, 적립금이 최소적립금보다 적은 경우 그 확인 결과를 근로자대표에게 알리지 아니한 퇴직연금사업자
2. 제16조제3항에 따른 적립금 부족을 해소하지 아니한 사용자
3. 제32조제2항에 따라 매년 1회 이상 교육을 하지 아니한 사용자
4. 제33조제5항에 따라 매년 1회 이상 교육을 하지 아니한 퇴직연금사업자
Any person falling under any of the following subparagraphs shall be subject to an administrative fine of not more than 10 million won. <Amended by Act No. 17229, Apr. 13, 2021> 1. A retirement pension provider who, in violation of Article 16 (2), fails to check whether the reserves exceed the minimum reserves and notify the employer of the results, or who fails to notify the representative of workers of the results when the reserves are less than the minimum reserves. 2. An employer who fails to resolve a shortage of reserves pursuant to Article 16 (3). 3. An employer who fails to provide education at least once a year as prescribed by Article 32 (2). 4. A retirement pension provider who fails to provide education at least once a year as prescribed by Article 33 (5).
다음 각 호의 어느 하나에 해당하는 자에게는 500만원 이하의 과태료를 부과한다. <개정 2021.4.13, 2022.1.11>
1. 제13조에 따른 확정급여형퇴직연금규약 또는 제19조에 따른 확정기여형퇴직연금규약을 신고하지 아니한 사용자
1의2. 제18조의2제1항에 따른 적립금운용위원회를 구성하지 아니한 사용자
1의3. 제18조의2제2항에 따른 적립금운용계획서를 작성하지 아니한 사용자
1의4. 제29조의2제3항에 따른 자료의 제출 요구에 따르지 아니한 퇴직연금사업자
2. 제32조제4항제2호에 따른 책무를 위반한 사용자
3. 제33조제2항에 따른 책무를 위반한 퇴직연금사업자
4. 제33조제6항을 위반하여 퇴직연금제도 취급실적을 제출하지 아니하거나 거짓으로 작성하여 제출한 퇴직연금사업자
5. 제35조에 따른 시정명령을 이행하지 아니한 사용자
Any person falling under any of the following subparagraphs shall be subject to an administrative fine of not more than 5 million won. <Amended by Act No. 17229, Apr. 13, 2021; Act No. 18026, Jan. 11, 2022> 1. An employer who fails to report a Defined Benefit Pension Plan under Article 13 or a Defined Contribution Pension Plan under Article 19. 1의2. An employer who fails to establish a Reserve Management Committee under Article 18-2 (1). 1의3. An employer who fails to prepare a Reserve Management Plan under Article 18-2 (2). 1의4. A retirement pension provider who fails to comply with a request for submission of data under Article 29-2 (3). 2. An employer who violates the duties under Article 32 (4) 2. 3. A retirement pension provider who violates the duties under Article 33 (2). 4. A retirement pension provider who, in violation of Article 33 (6), fails to submit the performance record of handling the retirement pension system or submits a falsely prepared record. 5. An employer who fails to comply with a corrective order under Article 35.
제1항 및 제2항에 따른 과태료는 대통령령으로 정하는 바에 따라 고용노동부장관이 부과ㆍ징수한다.
The administrative fines under paragraphs (1) and (2) shall be imposed and collected by the Minister of Employment and Labor, as prescribed by Presidential Decree.
