제104조(출산전후휴가 급여등의 감액) 고용노동부장관은 법 제77조제1항에 따라 준용되는 법 제73조제3항에 따라 피보험자가 출산전후휴가 기간, 유산ㆍ사산 휴가 기간, 배우자 출산휴가 기간 또는 난임치료휴가 기간 중 사업주로부터 통상임금에 해당하는 금품을 지급받은 경우로서 사업주로부터 받은 금품과 법 제75조에 따른 출산전후휴가 급여등을 합한 금액이 휴가 시작일을 기준으로 한 통상임금을 초과한 경우 그 초과하는 금액을 출산전후휴가 급여등에서 빼고 지급한다. 다만, 휴가기간 중에 통상임금이 인상된 피보험자에게 사업주가 인상된 통상임금과 출산전후휴가 급여등의 차액을 지급했을 때에는 그렇지 않다. <개정 2010.7.12, 2012.7.10, 2019.9.17, 2023.6.27, 2025.2.18>
