제104조의13 노무제공플랫폼사업자의 노무제공자 피보험자격 신고 등

노무제공플랫폼사업자의 노무제공자에 대한 피보험자격 취득 및 상실에 관한 사항의 신고를 그 사유가 발생한 날이 속하는 달의 다음 달 15일까지(노무제공자가 그 기일 이전에 신고할 것을 요구하는 경우에는 지체 없이) 고용노동부장관에게 해야 한다. <개정 2023.6.27>
The labor service platform provider shall report to the Minister of Employment and Labor the acquisition and loss of insured status of labor service providers by the 15th of the month following the month in which the cause occurred (or without delay if the labor service provider requests reporting before the deadline). <Amended by Act No. 18856, Jun. 27, 2023>
제1항에도 불구하고 노무제공플랫폼사업자가 노무제공계약 기간에 고용산재보험료징수법시행령 제56조의6제7항에 따라 근로복지공단에 월 보수액을 신고한 경우에는 노무제공자에 대한 피보험자격 취득 및 상실에 관한 사항을 신고한 것으로 본다. <개정 2022.12.14>
Notwithstanding paragraph ①, if the labor service platform provider reports the monthly remuneration to the Korea Workers' Compensation and Welfare Service in accordance with Article 56-6 (7) of the Enforcement Decree of the Industrial Accident Compensation Insurance and Employment Insurance Premium Collection Act during the period of the labor service contract, it shall be deemed that the acquisition and loss of insured status of the labor service provider has been reported. <Amended by Act No. 18556, Dec. 14, 2022>
제1항에도 불구하고 노무제공플랫폼사업자가 피보험자격 취득 및 상실에 관한 사항을 신고해야 하는 대상이 단기노무제공자인 경우로서 노무제공사업의 사업주와 단기노무제공자가 체결한 노무제공계약 기간에 제공된 노무제공일수, 노무제공대가 등이 적힌 노무제공내용 확인신고서를 그 사유가 발생한 날이 속하는 달의 다음 달 15일까지 고용노동부장관에게 제출한 경우에는 해당 단기노무제공자의 피보험자격 취득 및 상실에 관한 사항을 신고한 것으로 본다.
Notwithstanding paragraph ①, if the labor service platform provider is required to report the acquisition and loss of insured status for a short-term labor service provider and submits a labor service details confirmation report stating the number of days of labor service provided and the remuneration for labor service during the period of the labor service contract concluded between the employer of the labor service business and the short-term labor service provider to the Minister of Employment and Labor by the 15th of the month following the month in which the cause occurred, it shall be deemed that the acquisition and loss of insured status of the short-term labor service provider has been reported.
법 제77조의7제2항제2호에서 "사업장의 명칭ㆍ주소 등 대통령령으로 정하는 자료 또는 정보"란 다음 각 호의 자료 또는 정보를 말한다.
1. 사업장의 명칭ㆍ주소
2. 사업주(법인인 경우에는 대표자를 말한다)의 이름
3. 사업주의 사업자등록번호(법인인 경우에는 법인등록번호를 포함한다)
The "data or information prescribed by Presidential Decree, such as the name and address of the workplace" in Article 77-7 (2) 2 of the Act refers to the following data or information. 1. Name and address of the workplace 2. Name of the employer (if a corporation, the representative director) 3. Business registration number of the employer (including the corporate registration number if a corporation)
법 제77조의7제2항제3호에서 "노무제공자의 이름ㆍ직종ㆍ보수 등 대통령령으로 정하는 자료 또는 정보"란 다음 각 호의 자료 또는 정보를 말한다.
1. 노무제공자의 이름ㆍ직종
2. 노무제공자의 주민등록번호(외국인인 경우에는 외국인등록번호를 말한다)
3. 노무제공계약의 시작일 또는 종료일
4. 노무제공횟수 및 노무제공일수
5. 월보수액(단기노무제공자의 경우에는 노무제공대가를 말한다)
