고용노동부장관은 법 제23조에 따라 다음 각 호의 어느 하나에 해당하는 경우(이하 이 조에서 "임금피크제"라 한다)에는 근로자에게 임금피크제 지원금을 지급한다. 다만, 제2호에 해당하는 경우에는 사업주에게도 임금피크제 지원금을 지급한다. <개정 2010.12.31, 2013.1.25, 2013.12.24, 2014.12.31, 2021.6.8>
1. 사업주가 근로자대표의 동의를 받아 정년을 60세 이상으로 연장하거나 정년을 56세 이상 60세 미만으로 연장하면서 55세 이후부터 일정나이, 근속시점 또는 임금액을 기준으로 임금을 줄이는 제도를 시행하는 경우
2. 사업주가 제1호에 따른 제도를 시행하거나 제4호에 따라 정년퇴직 후 3개월 이내에 고용(이하 이 조 및 제28조의4에서 "재고용"이라 한다)하면서 주당 소정근로시간을 15시간 이상 30시간 이하로 단축하는 경우

4. 정년을 55세 이상으로 정한 사업주가 정년에 이른 사람을 재고용(재고용기간이 1년 미만인 경우는 제외한다)하면서 정년퇴직 이후부터 임금을 줄이는 경우
The Minister of Employment and Labor shall pay a wage peak system support fund to a worker in cases falling under any of the following subparagraphs pursuant to Article 23 of this Act (hereinafter referred to as the "wage peak system" in this Article). However, in cases falling under subparagraph 2, a wage peak system support fund shall also be paid to the employer. <Amended by Act No. 10896, Dec. 31, 2010, Act No. 11621, Jan. 25, 2013, Act No. 12156, Dec. 24, 2013, Act No. 12935, Dec. 31, 2014, Act No. 18391, Jun. 8, 2021> 1. Where an employer extends the retirement age to 60 years or older, or extends the retirement age to between 56 years and less than 60 years, and implements a system of reducing wages based on a certain age after 55, a period of service, or wage amount, with the consent of the labor representative. 2. Where an employer implements the system under subparagraph 1 or re-employs (hereinafter referred to as "re-employment" in this Article and Article 28-4) a person within 3 months after retirement due to reaching the retirement age under subparagraph 4, and reduces the scheduled working hours per week to between 15 hours and 30 hours. 3. Deleted <by Act No. 12156, Dec. 24, 2013> 4. Where an employer who has set the retirement age to 55 years or older reduces wages from after the retirement due to reaching the retirement age when re-employing a person who has reached the retirement age (excluding cases where the re-employment period is less than 1 year).
제1항에 따른 임금피크제 지원금은 해당 사업주에 고용되어 18개월 이상을 계속 근무한 사람으로서 피크임금(임금피크제의 적용으로 임금이 최초로 감액된 날이 속하는 연도의 직전 연도 임금을 말한다. 이하 이 조에서 같다)과 해당 연도의 임금을 비교하여 다음 각 호의 구분에 따른 비율 이상 낮아진 사람(해당 연도 임금이 고용노동부장관이 고시하는 금액 이상인 경우는 제외한다)에게 지급한다. <개정 2010.7.12, 2010.12.31, 2012.1.13, 2013.1.25, 2013.12.24, 2015.12.4, 2021.6.8>
1. 제1항제1호의 경우: 정년 연장기간에 따라 다음 각 목의 구분에 따른 비율. 다만, 상시 사용하는 근로자 수가 300명 미만인 사업은 100분의 10으로 한다.
- 가. 임금피크제 적용일부터 1년까지: 100분의 10
- 나. 임금피크제 적용일부터 1년 초과 2년까지: 100분의 15
- 다. 임금피크제 적용일부터 2년 초과 이후: 100분의 20
2. 제1항제2호의 경우: 100분의 30
3. 제1항제4호의 경우: 100분의 20. 다만, 상시 사용하는 근로자 수가 300명 미만인 사업은 100분의 10으로 한다.
A wage peak system support fund under paragraph ① shall be paid to a person who has been continuously employed by the employer for 18 months or longer, and whose wages have decreased by a rate equal to or greater than the rate specified in the following subparagraphs when comparing the peak wage (referring to the wage in the year immediately preceding the year in which the wage was first reduced due to the application of the wage peak system. In the case of subparagraph 1 of paragraph ①: The rate specified in the following items according to the period of retirement age extension. However, for businesses with fewer than 300 regularly employed workers, the rate shall be 10 percent. a. From the application date of the wage peak system to 1 year: 10 percent. b. From the application date of the wage peak system to 1 year exceeding 2 years: 15 percent. c. From the application date of the wage peak system to 2 years exceeding thereafter: 20 percent. 2. In the case of subparagraph 2 of paragraph ①: 30 percent. 3. In the case of subparagraph 4 of paragraph ①: 20 percent. However, for businesses with fewer than 300 regularly employed workers, the rate shall be 10 percent.
제1항에 따른 임금피크제 지원금은 해당 근로자의 피크임금과 해당 연도 임금의 차액, 임금인상률과 제1항제2호에 따른 소정근로시간 단축으로 인한 사업주의 노무비용 증가액 등을 고려하여 고용노동부장관이 고시하는 금액으로 한다. <개정 2010.7.12, 2010.12.31, 2014.12.31>

제1항에 따른 임금피크제 지원금은 임금피크제가 적용되는 날부터 5년 동안 지급한다. 다만, 고용기간이 5년보다 짧은 경우에는 그 고용기간 동안 지급하고, 제1항제1호에 따른 임금피크제 시행 이후 제1항제4호에 따라 재고용한 경우에도 최대 지급 기간은 통산하여 5년으로 한다. <개정 2013.12.24>
The wage peak system support fund under paragraph ① shall be paid for 5 years from the date the wage peak system is applied. However, if the employment period is shorter than 5 years, it shall be paid for the duration of the employment period, and even in cases of re-employment under subparagraph 4 after the implementation of the wage peak system under subparagraph 1, the maximum payment period shall be calculated cumulatively as 5 years. <Amended by Act No. 12156, Dec. 24, 2013>
제1항에 따른 임금피크제 지원금의 금액산정, 신청 및 지급 등에 필요한 사항은 고용노동부령으로 정한다. <개정 2010.12.31>
