제51조 자격검정 사업의 지원

고용노동부장관은 법 제31조제1항제2호에 따라 다음 각 호의 어느 하나에 해당하는 사업을 실시하는 자에게 그 사업의 실시에 필요한 비용의 전부 또는 일부를 지원할 수 있다. <개정 2008.9.18, 2010.7.12>

1. 사업주가 근로자의 기술향상을 위하여 실시하는 자격검정 사업
2. 「국가기술자격법」에 따른 국가기술자격 검정기관이 피보험자의 자격취득 편의를 위하여 실시하는 사업

The Minister of Employment and Labor may support all or part of the expenses necessary for the implementation of projects conducted by a person falling under any of the following subparagraphs pursuant to Article 31 (1) 2 of the Act. <Amended by Presidential Decree No. 20871, Sep. 18, 2008; Presidential Decree No. 21776, Jul. 12, 2010> 1. Qualification examination projects conducted by employers for the skill enhancement of their workers. 2. Projects conducted by national technical qualification examination institutions pursuant to the 「National Technical Qualifications Act」 for the convenience of insured persons in acquiring qualifications.

제1항제1호에 따른 자격검정 사업은 다음 각 호의 모든 요건을 갖추어야 한다. <개정 2010.7.12>

1. 사업주가 단독이나 공동으로 해당 사업 및 해당 사업과 관련된 사업의 근로자를 대상으로 실시하는 자격검정일 것
2. 자격 종목이 해당 사업에 필요한 지식 및 기능과 직접 관련될 것
3. 해당 자격을 취득한 근로자에게는 승진ㆍ승급ㆍ보수 등에서 우대할 수 있는 규정을 제정하여 시행하고 있을 것
4. 해당 자격을 취득하려고 하는 근로자에게 검정 사업과 관련하여 검정수수료 등 모든 비용을 받지 아니할 것
5. 자격검정이 영리를 목적으로 하는 것이 아닐 것
6. 그 밖에 고용노동부령으로 정하는 요건을 갖출 것

Qualification examination projects under subparagraph 1 of paragraph ① shall meet all of the following requirements. <Amended by Presidential Decree No. 21776, Jul. 12, 2010> 1. The qualification examination shall be conducted by an employer, either alone or jointly, targeting workers of the relevant business and businesses related to the relevant business. 2. The qualification categories shall be directly related to the knowledge and skills required for the relevant business. 3. Provisions that provide preferential treatment, such as promotion, wage increase, or remuneration, to workers who have acquired the qualification shall have been established and implemented. 4. Workers who intend to acquire the qualification shall not be charged any fees, including examination fees, in connection with the examination project. 5. The qualification examination shall not be for the purpose of profit. 6. Other requirements prescribed by the Minister of Employment and Labor.

제1항에 따른 비용의 지원신청과 지원방법 등에 관하여 필요한 사항은 고용노동부령으로 정한다. <개정 2010.7.12>
