제118조 과태료

다음 각 호의 어느 하나에 해당하는 사업주, 보험사무대행기관, 노무제공플랫폼사업자의 대표자 또는 대리인ㆍ사용인, 그 밖의 종업원에게는 300만원 이하의 과태료를 부과한다. <개정 2008.12.31, 2019.8.27, 2020.5.26, 2020.6.9, 2021.1.5, 2022.12.31>
1. 제15조(제77조의5제1항 및 제77조의10제1항에서 준용하는 경우를 포함한다), 제77조의2제3항 및 제77조의7제1항을 위반하여 신고를 하지 아니하거나 거짓으로 신고한 자
2. 제42조제3항 후단(제77조의5제2항 및 제77조의10제2항에서 준용하는 경우를 포함한다)을 위반하여 이직확인서를 발급하여 주지 아니하거나 거짓으로 작성하여 발급하여 준 자
3. 제43조제4항 후단(제77조의5제2항 및 제77조의10제2항에서 준용하는 경우를 포함한다)을 위반하여 이직확인서를 제출하지 아니하거나 거짓으로 작성하여 제출한 자
4. 제108조제1항(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)에 따른 요구에 따르지 아니하여 보고를 하지 아니하거나 거짓으로 보고한 자, 같은 요구에 따르지 아니하여 문서를 제출하지 아니하거나 거짓으로 적은 문서를 제출한 자 또는 출석하지 아니한 자
5. 제108조제2항(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)에 따른 요구에 따르지 아니하여 증명서를 내주지 아니한 자
6. 제109조제1항(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)에 따른 질문에 답변하지 아니하거나 거짓으로 진술한 자 또는 조사를 거부ㆍ방해하거나 기피한 자
7. 제77조의7제2항을 위반하여 자료 또는 정보의 제공 요청에 따르지 아니한 자
8. 제77조의7제5항을 위반하여 노무제공자의 피보험자격의 신고와 관련된 자료 또는 정보를 보관하지 아니한 자
An employer, an insurance affairs agency, or the representative, agent, employee, or other staff member of a labor supply platform business operator who falls under any of the following subparagraphs shall be subject to an administrative fine of up to 3 million won. <Amended by Act No. 11620, Dec. 31, 2008, Act No. 16513, Aug. 27, 2019, Act No. 17235, May 26, 2020, Act No. 17241, June 9, 2020, Act No. 17744, Jan. 5, 2021, Act No. 18649, Dec. 31, 2022> 1. A person who fails to report or falsely reports in violation of Article 15 (including cases applied mutatis mutandis under Article 77-2(1) and Article 77-10(1)), Article 77-2(3), and Article 77-7(1) 2. A person who fails to issue or falsely prepares and issues a separation confirmation certificate in violation of the latter part of Article 42(3) (including cases applied mutatis mutandis under Article 77-2(2) and Article 77-10(2)) 3. A person who fails to submit or falsely prepares and submits a separation confirmation certificate in violation of the latter part of Article 43(4) (including cases applied mutatis mutandis under Article 77-2(2) and Article 77-10(2)) 4. A person who fails to report or falsely reports in response to a request under Article 108(1) (including cases applied mutatis mutandis under Article 77-2(3) and (4), and Article 77-10(3) and (4)), a person who fails to submit documents or submits falsely prepared documents, or a person who fails to appear in response to the same request 5. A person who fails to issue a certificate in response to a request under Article 108(2) (including cases applied mutatis mutandis under Article 77-2(3) and (4), and Article 77-10(3) and (4)) 6. A person who fails to answer questions, falsely states in response to questions under Article 109(1) (including cases applied mutatis mutandis under Article 77-2(3) and (4), and Article 77-10(3) and (4)), or refuses, obstructs, or evades an investigation 7. A person who fails to comply with a request for provision of data or information in violation of Article 77-7(2) 8. A person who fails to keep data or information related to the reporting of the insured status of a labor provider in violation of Article 77-7(5)
다음 각 호의 어느 하나에 해당하는 피보험자, 수급자격자 또는 지급되지 아니한 실업급여의 지급을 청구하는 자에게는 100만원 이하의 과태료를 부과한다. <개정 2008.12.31, 2020.6.9, 2021.1.5, 2022.12.31>

제1항부터 제3항까지의 규정에 따른 과태료는 대통령령으로 정하는 바에 따라 고용노동부장관이 부과ㆍ징수한다. <개정 2010.6.4>
