제13조 피보험자격의 취득일

근로자인 피보험자는 이 법이 적용되는 사업에 고용된 날에 피보험자격을 취득한다. 다만, 다음 각 호의 경우에는 각각 그 해당되는 날에 피보험자격을 취득한 것으로 본다. <개정 2011.7.21, 2019.1.15, 2020.5.26, 2021.1.5>
1. 제10조 및 제10조의2에 따른 적용 제외 근로자였던 사람이 이 법의 적용을 받게 된 경우에는 그 적용을 받게 된 날
2. 고용산재보험료징수법 제7조에 따른 보험관계 성립일 전에 고용된 근로자의 경우에는 그 보험관계가 성립한 날
An insured person who is a worker shall acquire insured status on the day of being employed in a business to which this Act applies. However, in cases falling under each of the following subparagraphs, the insured status shall be deemed to have been acquired on the respective day designated: 1. In the case where a person who was an excluded worker pursuant to Articles 10 and 10-2 becomes subject to this Act, the day on which such person becomes subject to this Act. 2. In the case of a worker employed before the date of establishment of the insurance relationship pursuant to Article 7 of the Employment and Industrial Accident Insurance Dues Collection Act, the date of establishment of the insurance relationship.
자영업자인 피보험자는 고용산재보험료징수법 제49조의2제1항 및 같은 조 제12항에서 준용하는 같은 법 제7조제3호에 따라 보험관계가 성립한 날에 피보험자격을 취득한다. <신설 2011.7.21, 2021.1.5>
An insured person who is a self-employed person shall acquire insured status on the date of establishment of the insurance relationship pursuant to Article 7, subparagraph 3 of the Employment and Industrial Accident Insurance Dues Collection Act, as applied mutatis mutandis under Article 49-2(1) and Article 49-2(12) of the same Act.
