Article 68 (Restriction on Payment of Employment Promotion Allowance)
제68조 취업촉진 수당의 지급 제한

거짓이나 그 밖의 부정한 방법으로 실업급여를 받았거나 받으려 한 사람에게는 그 급여를 받은 날 또는 받으려 한 날부터의 취업촉진 수당을 지급하지 아니한다. 다만, 그 급여와 관련된 이직 이후에 새로 수급자격을 취득하면 그 새로운 수급자격에 따른 취업촉진 수당은 그러하지 아니하다. <개정 2020.5.26>
A person who has received or attempted to receive unemployment benefits by fraud or other dishonest means shall not be paid the employment promotion allowance from the date of receiving or attempting to receive such benefits. However, if a new eligibility for benefits is acquired after the separation related to such benefits, the employment promotion allowance based on the new eligibility shall not be subject to this restriction. <Amended by Act No. 17272, May 26, 2020>
제1항 본문에도 불구하고 거짓이나 그 밖의 부정한 방법이 제47조제1항에 따른 신고의무의 불이행 또는 거짓의 신고 등 대통령령으로 정하는 사유에 해당하면 취업촉진 수당의 지급을 제한하지 아니한다. 다만, 2회 이상의 위반행위를 한 경우에는 제1항 본문에 따른다.
Notwithstanding the main sentence of paragraph ①, if the fraud or other dishonest means fall under reasons prescribed by Presidential Decree, such as non-performance of the reporting obligation under Article 47 (1) or a false report, the payment of the employment promotion allowance shall not be restricted. However, in the case of two or more violations, the main sentence of paragraph ① shall apply.
거짓이나 그 밖의 부정한 방법으로 실업급여를 지급받았거나 받으려 한 사람이 제1항 또는 제2항에 따라 취업촉진 수당을 지급받을 수 없게 되어 조기재취업 수당을 지급받지 못하게 된 경우에도 제64조제4항을 적용할 때는 그 지급받을 수 없게 된 조기재취업 수당을 지급받은 것으로 본다. <개정 2020.5.26>
