자영업자인 피보험자이었던 수급자격자에 대한 기초일액은 다음 각 호의 구분에 따른 기간 동안 본인이 납부한 보험료의 산정기초가 되는 고용산재보험료징수법 제49조의2제3항에 따라 고시된 보수액을 전부 합산한 후에 그 기간의 총일수로 나눈 금액으로 한다. <개정 2021.1.5>
1. 수급자격과 관련된 피보험기간이 3년 이상인 경우: 마지막 폐업일 이전 3년의 피보험기간
2. 수급자격과 관련된 피보험기간이 3년 미만인 경우: 수급자격과 관련된 그 피보험기간
The basic daily wage for a beneficiary who was a self-employed insured person shall be the amount obtained by dividing the total sum of the wage amount announced pursuant to Article 49-2 (3) of the Employment and Industrial Accident Compensation Insurance Act, which was the basis for calculating the premiums paid by the person, by the total number of days in the relevant period, during the period specified in each of the following subparagraphs. <Amended by 2021.1.5> 1. Where the insured period related to the eligibility for benefit is 3 years or more: The insured period of the last 3 years prior to the date of business closure 2. Where the insured period related to the eligibility for benefit is less than 3 years: The insured period related to the eligibility for benefit
제1항에도 불구하고 자영업자인 피보험자이었던 수급자격자가 제50조제4항에 따라 피보험기간을 합산하게 됨에 따라 제69조의6에서 정한 소정급여일수가 추가로 늘어나는 경우에는 그 늘어난 일수분에 대한 기초일액은 제1항에 따라 산정된 기초일액으로 하되, 그 기초일액이 다음 각 호에 해당하는 경우에는 각각 해당 호에 따른 금액으로 한다.
1. 기초일액이 최저기초일액에 미치지 못하는 경우에는 최저기초일액
2. 기초일액이 제45조제5항에 따라 대통령령으로 정하는 금액을 초과하는 경우에는 그 대통령령으로 정하는 금액
Notwithstanding paragraph (1), where the basic daily wage for the additional days in the prescribed benefit days as stipulated in Article 69-6 increases due to the aggregation of the insured period pursuant to Article 50 (4) by a beneficiary who was a self-employed insured person, the basic daily wage for the increased number of days shall be the basic daily wage calculated pursuant to paragraph (1), provided that if such basic daily wage falls under any of the following subparagraphs, it shall be the amount prescribed in the respective subparagraph. 1.
