제77조의4 예술인의 출산전후급여등

고용노동부장관은 예술인인 피보험자 또는 피보험자였던 사람이 출산 또는 유산ㆍ사산을 이유로 노무를 제공할 수 없는 경우에는 출산전후급여 등(이하 "출산전후급여등"이라 한다)을 지급한다. 다만, 같은 자녀에 대하여 제75조에 따른 출산전후휴가 급여등 및 제77조의9제1항에 따른 출산전후급여등의 지급요건을 동시에 충족하는 경우 등에 대해서는 대통령령으로 정하는 바에 따라 지급한다. <개정 2021.1.5, 2022.6.10>
The Minister of Employment and Labor shall grant maternity and paternity benefits, etc. (hereinafter referred to as "maternity and paternity benefits, etc.") to an insured artist or a former insured artist who is unable to provide labor due to childbirth, miscarriage, or stillbirth. However, in cases where the conditions for maternity and paternity benefits, etc. under Article 75 and the conditions for maternity and paternity benefits, etc. under Article 77-9(1) for the same child are met simultaneously, the benefits shall be granted as prescribed by Presidential Decree. <Amended by Jan. 5, 2021, Jun. 10, 2022>
제1항에 따른 출산전후급여등의 지급요건, 지급수준 및 지급기간 등은 대통령령으로 정하는 바에 따른다.
The conditions, levels, and duration of maternity and paternity benefits, etc. under paragraph (1) shall be prescribed by Presidential Decree.
제1항과 제2항에 따른 출산전후급여등의 신청 및 지급에 필요한 사항은 고용노동부령으로 정한다.
Matters necessary for the application and payment of maternity and paternity benefits, etc. under paragraphs (1) and (2) shall be prescribed by Ordinance of the Ministry of Employment and Labor.
