제6조 외국환거래의 정지 등

재정경제부장관은 천재지변, 전시ㆍ사변, 국내외 경제사정의 중대하고도 급격한 변동, 그 밖에 이에 준하는 사태가 발생하여 부득이 하다고 인정되는 경우에는 대통령령으로 정하는 바에 따라 다음 각 호의 어느 하나에 해당하는 조치를 할 수 있다. <개정 2011.4.30, 2017.1.17, 2025.10.1>
1. 이 법을 적용받는 지급 또는 수령, 거래의 전부 또는 일부에 대한 일시 정지
2. 지급수단 또는 귀금속을 한국은행ㆍ정부기관ㆍ외국환평형기금ㆍ금융회사등에 보관ㆍ예치 또는 매각하도록 하는 의무의 부과
3. 비거주자에 대한 채권을 보유하고 있는 거주자로 하여금 그 채권을 추심하여 국내로 회수하도록 하는 의무의 부과
In cases where the Minister of Economy and Finance deems it unavoidable due to the occurrence of a natural disaster, war, armed conflict, grave and rapid changes in domestic or foreign economic conditions, or other similar situations, he/she may take any of the following measures pursuant to Presidential Decree: <Amended by Act No. 10655, Apr. 30, 2011; Act No. 14035, Jan. 17, 2017; Act No. 2025.10.1> 1. Temporary suspension of all or part of payments, receipts, or transactions to which this Act applies. 2. Imposition of an obligation on persons to deposit, entrust, or sell means of payment or precious metals with the Bank of Korea, government agencies, the Foreign Exchange Stabilization Fund, financial companies, etc. 3. Imposition of an obligation on residents holding claims against non-residents to collect such claims and repatriate them into the Republic of Korea.
재정경제부장관은 다음 각 호의 어느 하나에 해당된다고 인정되는 경우에는 대통령령으로 정하는 바에 따라 자본거래를 하려는 자에게 허가를 받도록 하는 의무를 부과하거나, 자본거래를 하는 자에게 그 거래와 관련하여 취득하는 지급수단의 일부를 한국은행ㆍ외국환평형기금 또는 금융회사등에 예치하도록 하는 의무를 부과하는 조치를 할 수 있다. <개정 2011.4.30, 2025.10.1>
1. 국제수지 및 국제금융상 심각한 어려움에 처하거나 처할 우려가 있는 경우
2. 대한민국과 외국 간의 자본 이동으로 통화정책, 환율정책, 그 밖의 거시경제정책을 수행하는 데에 심각한 지장을 주거나 줄 우려가 있는 경우
In cases where the Minister of Economy and Finance deems that any of the following applies, he/she may impose an obligation on those intending to engage in capital transactions to obtain permission, or impose an obligation on those engaging in capital transactions to deposit a portion of the means of payment acquired in connection with such transactions with the Bank of Korea, the Foreign Exchange Stabilization Fund, or financial companies, etc., pursuant to Presidential Decree: <Amended by Act No. 10655, Apr. 30, 2011; Act No. 2025.10.1> 1. If facing or likely to face serious difficulties in terms of the balance of payments or international finance. 2. If capital movement between the Republic of Korea and foreign countries is causing or likely to cause serious disruption to the implementation of monetary policy, exchange rate policy, or other macroeconomic policies.
제1항과 제2항에 따른 조치는 특별한 사유가 없으면 6개월의 범위에서 할 수 있으며, 그 조치 사유가 소멸된 경우에는 그 조치를 즉시 해제하여야 한다.
Measures taken under paragraphs (1) and (2) shall be for a period of up to six months, unless there are special grounds, and if the grounds for such measures cease to exist, the measures shall be immediately lifted.
제1항부터 제3항까지의 규정에 따른 조치는 「외국인투자 촉진법」 제2조제1항제4호에 따른 외국인투자에 대하여 적용하지 아니한다. <개정 2009.1.30>
Measures taken under paragraphs (1) through (3) shall not apply to foreign investments as defined in Article 2 (1) 4 of the 「Foreign Investment Promotion Act」. <Amended by Act No. 9411, Jan. 30, 2009>
재정경제부장관은 제1항제3호의 조치를 하기 위하여 필요한 경우 해당 거주자의 관할 세무관서의 장에게 「국제조세조정에 관한 법률」 제52조제3호에 따른 해외금융계좌정보의 제공을 요청할 수 있다. 이 경우 해외금융계좌정보의 제공을 요청받은 관할 세무관서의 장은 특별한 사정이 없으면 그 요청에 따라야 한다. <신설 2017.1.17, 2020.12.22, 2025.10.1>
If necessary for taking measures under Article 1 (3), the Minister of Economy and Finance may request the head of the competent tax office of the relevant resident to provide information on overseas financial accounts pursuant to Article 52 (3) of the 「Law on the Coordination of International Taxation」. In such cases, the head of the competent tax office who receives the request for information on overseas financial accounts shall comply with the request unless there are special circumstances. <Newly Added by Act No. 14035, Jan. 17, 2017; Act No. 17753, Dec. 22, 2020; Act No. 2025.10.1>
