사용자가 외국인근로자에게 기숙사를 제공하는 경우에는 「근로기준법」 제100조에서 정하는 기준을 준수하고, 건강과 안전을 지킬 수 있도록 하여야 한다.
Where an employer provides a dormitory to a foreign worker, the employer shall comply with the standards prescribed in Article 100 of the 「Labor Standards Act」 and ensure that health and safety are protected.
사용자는 제1항에 따라 기숙사를 제공하는 경우 외국인근로자와 근로계약을 체결할 때에 외국인근로자에게 다음 각 호의 정보를 사전에 제공하여야 한다. 근로계약 체결 후 다음 각 호의 사항을 변경하는 경우에도 또한 같다.
1. 기숙사의 구조와 설비
2. 기숙사의 설치 장소
3. 기숙사의 주거 환경
4. 기숙사의 면적
5. 그 밖에 기숙사 설치 및 운영에 필요한 사항
When an employer provides a dormitory pursuant to paragraph ①, the employer shall provide the following information in advance to the foreign worker when concluding a labor contract. The same shall apply if the matters referred to in the following subparagraphs are changed after the conclusion of the labor contract. 1. Structure and facilities of the dormitory 2. Location of the dormitory 3. Living environment of the dormitory 4. Area of the dormitory 5. Other matters necessary for the installation and operation of the dormitory
제2항에 따른 기숙사 정보 제공의 기준 등에 필요한 사항은 대통령령으로 정한다.
Matters necessary for the standards for providing dormitory information under paragraph ②, etc. shall be prescribed by Presidential Decree.
