제23조의2 부담금의 납부담보

보건복지부장관은 부담금의 납부 보전을 위하여 대통령령이 정하는 바에 따라 제23조제1항에 따른 제조자 및 수입판매업자에게 담보의 제공을 요구할 수 있다. <개정 2008.2.29, 2010.1.18, 2021.7.27>
The Minister of Health and Welfare may, for the purpose of securing the payment of the levy, require manufacturers and importers and sellers, referred to in Article 23 (1), to provide security, in accordance with the provisions of a Presidential Decree. <Amended by Act No. 9453, Feb. 29, 2008; Act No. 9931, Jan. 18, 2010; Act No. 18311, Jul. 27, 2021>
보건복지부장관은 제1항에 따라 담보제공의 요구를 받은 제조자 및 수입판매업자가 담보를 제공하지 아니하거나 요구분의 일부만을 제공한 경우 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수 및 세관장에게 담배의 반출금지를 요구할 수 있다. <개정 2008.2.29, 2010.1.18, 2021.7.27>
If a manufacturer or importer and seller, who has been required to provide security under paragraph (1), fails to provide security or provides only a portion of the required amount, the Minister of Health and Welfare may request the Mayor of Seoul Special City, the Mayor of Busan Metropolitan City, the Mayor of Daegu Metropolitan City, the Mayor of Gwangju Metropolitan City, the Mayor of Daejeon Metropolitan City, the Mayor of Sejong Special Self-Governing City, the Governor of Gyeongsangbuk-do Province, the Governor of Gyeongsangnam-do Province, the Governor of Jeollabuk-do Province, the Governor of Jeollanam-do Province, the Governor of Chungcheongbuk-do Province, the Governor of Chungcheongnam-do Province, the Governor of Gangwon-do Province, the Governor of Gyeonggi Province, the Governor of Jeju Special Self-Governing Province, or the head of a customs office to prohibit the export of tobacco. <Amended by Act No. 9453, Feb. 29, 2008; Act No. 9931, Jan. 18, 2010; Act No. 18311, Jul. 27, 2021>
제2항에 따라 담배의 반출금지 요구를 받은 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수 및 세관장은 이에 응하여야 한다. <개정 2021.7.27>
