Article 9-5 (Smoking Cessation Guides)
제9조의5 금연지도원

시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 금연을 위한 조치를 위하여 대통령령으로 정하는 자격이 있는 사람 중에서 금연지도원을 위촉할 수 있다.
The Governor of a Special City, Metropolitan City, Province, or the Mayor, County Governor, or District Head shall appoint smoking cessation guides from among persons with qualifications prescribed by Presidential Decree, for measures for smoking cessation.
금연지도원의 직무는 다음 각 호와 같다.
1. 금연구역의 시설기준 이행 상태 점검
2. 금연구역에서의 흡연행위 감시 및 계도
3. 금연을 위한 조치를 위반한 경우 관할 행정관청에 신고하거나 그에 관한 자료 제공
4. 그 밖에 금연 환경 조성에 관한 사항으로서 대통령령으로 정하는 사항
The duties of smoking cessation guides shall be as follows: 1. Inspection of the status of compliance with facility standards in non-smoking areas. 2. Monitoring and guidance of smoking in non-smoking areas. 3. Reporting violations of measures for smoking cessation to the competent administrative agency or providing data concerning such violations. 4. Other matters related to the creation of a smoking-free environment as prescribed by Presidential Decree.
금연지도원은 제2항의 직무를 단독으로 수행하려면 미리 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장의 승인을 받아야 하며, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 승인서를 교부하여야 한다.
When a smoking cessation guide intends to perform the duties under paragraph ② independently, they shall obtain prior approval from the Governor of a Special City, Metropolitan City, Province, or the Mayor, County Governor, or District Head, and the Governor of a Special City, Metropolitan City, Province, or the Mayor, County Governor, or District Head shall issue a certificate of approval.
금연지도원이 제2항에 따른 직무를 단독으로 수행하는 때에는 승인서와 신분을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다.
When a smoking cessation guide performs the duties under paragraph ② independently, they shall carry and present to the relevant persons a certificate of approval and an identification document indicating their status.
제1항에 따라 금연지도원을 위촉한 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 금연지도원이 그 직무를 수행하기 전에 직무 수행에 필요한 교육을 실시하여야 한다.
The Governor of a Special City, Metropolitan City, Province, or the Mayor, County Governor, or District Head who has appointed a smoking cessation guide under paragraph ① shall provide training necessary for the performance of duties before the smoking cessation guide commences performing their duties.
금연지도원은 제2항에 따른 직무를 수행하는 경우 그 권한을 남용하여서는 아니 된다.
Smoking cessation guides shall not abuse their authority in performing the duties under paragraph ②.
시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 금연지도원이 다음 각 호의 어느 하나에 해당하면 그 금연지도원을 해촉하여야 한다.
1. 제1항에 따라 대통령령으로 정한 자격을 상실한 경우
2. 제2항에 따른 직무와 관련하여 부정한 행위를 하거나 그 권한을 남용한 경우
3. 그 밖에 개인사정, 질병이나 부상 등의 사유로 직무 수행이 어렵게 된 경우
The Governor of a Special City, Metropolitan City, Province, or the Mayor, County Governor, or District Head shall dismiss a smoking cessation guide if the guide falls under any of the following subparagraphs: 1. Loss of qualifications prescribed by Presidential Decree under paragraph ①. 2. Engaging in fraudulent acts or abusing authority in connection with the duties under paragraph ②. 3. Other reasons such as personal circumstances, illness, or injury that make it difficult to perform duties.
금연지도원의 직무범위 및 교육, 그 밖에 필요한 사항은 대통령령으로 정한다.
The scope of duties and training of smoking cessation guides, and other necessary matters shall be prescribed by Presidential Decree.
