제104조 통고처분의 절차

청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 법 제102조제1항에 따라 통고처분을 하는 때에는 제72조에 따른 심사결정서와 통고서를 작성하여야 한다. <개정 2018.5.8>
The Commissioner, Director of the Office, Director of the Branch Office, or Director of the Shelter shall prepare a decision of examination and a notice in accordance with Article 102 (1) of the Act. <Amended by Act No. 15590, May 8, 2018>
제1항에 따른 통고서에는 다음 각 호의 사항을 적고 청장ㆍ사무소장ㆍ출장소장 또는 보호소장이 서명날인하여야 한다. <개정 2016.9.29, 2018.5.8>
1. 통고처분을 받은 사람의 성명ㆍ성별ㆍ생년월일 및 주소
2. 범칙금액
3. 위반사실
4. 적용 법조문
5. 납부장소 및 납부기한
6. 통고처분 연월일
The notice referred to in paragraph ① shall state the following matters and shall be signed and sealed by the Commissioner, Director of the Office, Director of the Branch Office, or Director of the Shelter. <Amended by Act No. 14408, Sep. 29, 2016, Act No. 15590, May 8, 2018> 1. 청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 조사 결과 위반사실이 여권 또는 서류 등에 의하여 명백히 인정되고 처분에 다툼이 없는 출입국사범에 대해서는 제57조에 따른 용의사실 인지보고서, 제59조제1항에 따른 용의자신문조서, 제1항에 따른 심사결정서 및 통고서를 따로 작성하지 아니하고 출입국사범 심사결정 통고서를 작성하는 것으로 갈음할 수 있다. <개정 2018.5.8>
The Commissioner, Director of the Office, Director of the Branch Office, or Director of the Shelter may, for an immigration offender whose violation is clearly recognized based on passport or documents, etc., and who does not dispute the disposition, prepare a decision of examination and notification for immigration offenders in lieu of separately preparing a report of suspected facts under Article 57, an examination record of the suspect under Article 59 (1), and a decision of examination and a notice under paragraph ①. <Amended by Act No. 15590, May 8, 2018>
