Article 36 (Period of Departure Suspension for Foreigners)
제36조 외국인의 출국정지기간

법 제29조에 따른 출국정지기간은 다음 각 호와 같다. <개정 2012.1.13, 2019.12.24, 2020.12.29>
1. 법 제4조제1항 각 호의 어느 하나에 해당하는 외국인: 3개월 이내
2. 법 제4조제2항에 해당하는 외국인: 1개월 이내. 다만, 다음 각 목에 해당하는 외국인은 그 목에서 정한 기간으로 한다.
- 가. 도주 등 특별한 사유가 있어 수사진행이 어려운 외국인: 3개월 이내
- 나. 소재를 알 수 없어 기소중지 또는 수사중지(피의자중지로 한정한다)가 된 외국인: 3개월 이내
- 다. 기소중지 또는 수사중지(피의자중지로 한정한다)가 된 경우로서 체포영장 또는 구속영장이 발부된 외국인: 영장 유효기간 이내
The period of departure suspension pursuant to Article 29 of the Act shall be as follows. <Amended by Act No. 11210, Jan. 13, 2012, Act No. 16851, Dec. 24, 2019, Act No. 17804, Dec. 29, 2020> 1. Foreigners falling under any subparagraph of Article 4(1) of the Act: Within 3 months 2. Foreigners falling under Article 4(2) of the Act: Within 1 month. However, for foreigners falling under any of the following sub-paragraphs, the period shall be as prescribed in such sub-paragraph. a. Foreigners for whom it is difficult to proceed with investigations due to special reasons such as escape: Within 3 months b. Foreigners whose whereabouts are unknown and for whom indictment suspension or investigation suspension (limited to suspension of suspect) has been ordered: Within 3 months c. In cases where indictment suspension or investigation suspension (limited to suspension of suspect) has been ordered and an arrest warrant or detention warrant has been issued for the foreigner: Within the validity period of the warrant
제1항제2호에 해당하는 사람 중 기소중지 또는 수사중지(피의자중지로 한정한다)된 사람의 소재가 발견된 경우에는 출국정지 예정기간을 발견된 날부터 10일 이내로 한다. <신설 2012.1.13, 2020.12.29>
If the whereabouts of a person suspended from indictment or investigation (limited to suspension of suspect) among those falling under Article 1(2) are discovered, the period of departure suspension shall be within 10 days from the date of discovery. <Newly added by Act No. 11210, Jan. 13, 2012, Act No. 17804, Dec. 29, 2020>
제1항에 따른 외국인의 출국정지기간의 계산에 관하여는 제1조의4를 준용한다. 이 경우 "출국금지기간"은 "출국정지기간"으로 본다. <개정 2012.1.13>
With regard to the calculation of the period of departure suspension for foreigners under paragraph (1), Article 1-4 shall apply mutatis mutandis. In this case, "period of departure prohibition" shall be deemed as "period of departure suspension". <Amended by Act No. 11210, Jan. 13, 2012>
