제82조 선박등의 검색 및 심사

출입국관리공무원이 선박등에 승선하여 법 제69조 및 제70조에 따른 검색 및 심사를 할 때에는 다음 각 호의 사항을 확인하여야 한다.
1. 여권 또는 선원신분증명서가 유효한지 여부
2. 승무원 또는 승객이 정당한 절차에 따라 승선하였는지 여부
3. 승선 중인 승무원 또는 승객과 법 제75조제1항에 따라 제출된 승무원명부 및 승객명부의 명단이 일치하는지 여부
4. 승무원 또는 승객 중에 출입국이 금지된 사람이 있는지 여부
5. 입항선박의 경우 검색 전에 승무원 또는 승객이 하선한 사실이 있는지 여부
6. 출항선박의 경우 검색 시까지 선박으로 돌아오지 아니한 승무원 또는 승객이 있는지 여부
7. 승무원 또는 승객 외에 승선허가를 받지 아니하고 선박등에 무단출입한 사람이 있는지 여부
8. 정당한 절차를 거치지 아니하고 출입국하려는 사람이 선박등에 숨어 있는지 여부
When an immigration control official boards a vessel, etc. to conduct searches and examinations pursuant to Articles 69 and 70 of the Act, they shall verify the following matters: 1. Whether the passport or seaman's identification certificate is valid 2. Whether the crew members or passengers boarded in accordance with proper procedures 3. Whether the list of crew members or passengers on board matches the crew list and passenger list submitted pursuant to Article 75 (1) of the Act 4. Whether there are any persons among the crew members or passengers who are prohibited from entering or leaving the country 5. In the case of an arriving vessel, whether any crew members or passengers have disembarked prior to the search 6. In the case of a departing vessel, whether there are any crew members or passengers who have not returned to the vessel by the time of the search 7. Whether there are any persons other than crew members or passengers who have unauthorizedly entered the vessel, etc. without permission to board 8. Whether there are any persons hiding on the vessel, etc. who intend to enter or leave the country without going through proper procedures
청장ㆍ사무소장 또는 출장소장은 제1항에 따른 출입국관리공무원의 승선검색으로 인하여 선박등의 출항이 지연될 우려가 있거나 그 밖에 필요하다고 인정할 때에는 선박등의 출항에 앞서 여권 또는 선원신분증명서 등 필요한 서류를 제출하게 하여 미리 승무원 및 승객의 자격을 심사하게 할 수 있다. <개정 2018.5.8>
