Article 88-3 (Change of Detention Facility for Repatriation between Ports of Entry and Exit)
제88조의3 출입국항 사이의 송환대기장소의 변경

청장ㆍ사무소장 또는 출장소장은 다음 각 호의 사유로 송환대상외국인이 지정된 송환기한 내에 출국할 수 없는 경우에는 송환대기장소를 송환이 가능한 다른 출입국항의 출국대기실로 변경할 수 있다.
1. 해당 출입국항에 출국할 선박등이 없는 경우
2. 그 밖에 출입국항 사이 송환대기장소의 변경이 필요한 부득이한 사유가 있는 경우
The Commissioner General, the head of an office, or the head of a branch office may change the detention facility for repatriation to a departure waiting room at another port of entry and exit where repatriation is possible, if a foreign national subject to repatriation cannot depart within the designated period for repatriation due to any of the following reasons. 1. There are no vessels, etc. for departure at the relevant port of entry and exit. 2. There are other unavoidable reasons necessitating the change of the detention facility for repatriation between ports of entry and exit.
청장ㆍ사무소장 또는 출장소장이 제1항에 따라 송환대기장소를 변경하려는 때에는 그 송환대상외국인에게 변경되는 출입국항, 변경사유, 변경일시 등을 알려야 한다.
When the Commissioner General, the head of an office, or the head of a branch office intends to change the detention facility for repatriation pursuant to paragraph ①, they shall inform the foreign national subject to repatriation of the port of entry and exit to which the facility is changed, the reason for the change, and the date and time of the change.
청장ㆍ사무소장 또는 출장소장은 제1항에 따른 송환대기장소의 변경을 위하여 관할 출입국항의 관계기관의 장에게 출입 조치 등 필요한 사항을 요청할 수 있다. 이 경우 요청받은 기관의 장은 정당한 사유가 없으면 이에 따라야 한다.
The Commissioner General, the head of an office, or the head of a branch office may request the head of a related agency at the port of entry and exit having jurisdiction to take necessary measures, such as entry and exit procedures, for the change of the detention facility for repatriation pursuant to paragraph ①. In this case, the head of the requested agency shall comply unless there is a justifiable reason not to do so.
