Article 88-7 (Reissuance of Refugee Travel Document)

제88조의7 난민여행증명서의 재발급

①

법무부장관은 난민여행증명서를 발급받은 사람에게 다음 각 호의 어느 하나에 해당하는 사유가 있으면 난민여행증명서를 재발급할 수 있다.

  1. 1. 난민여행증명서가 분실되거나 없어진 경우

  2. 2. 난민여행증명서가 훼손되어 못 쓰게 된 경우

  3. 3. 그 밖에 법무부장관이 재발급할 필요가 있다고 인정하는 경우

The Minister of Justice may reissue a refugee travel document to a person who has received one, if any of the following grounds exist: 1. The refugee travel document is lost or missing. 2. The refugee travel document is damaged and unusable. 3. The Minister of Justice deems it necessary to reissue for other reasons.

제1항에 따라 난민여행증명서를 재발급받으려는 사람은 난민여행증명서 재발급신청서에 그 사유를 소명하는 서류와 사진 1장을 첨부하여 법무부장관에게 제출해야 한다. 다만, 대한민국 밖에서 난민여행증명서를 재발급받으려는 사람은 재외공관의 장을 거쳐 법무부장관에게 제출해야 한다. <개정 2016.9.29, 2019.12.24, 2020.8.5>

A person who wishes to have a refugee travel document reissued pursuant to paragraph ① shall submit an application for reissuance of a refugee travel document, along with documents explaining the grounds and one photograph, to the Minister of Justice. However, a person who wishes to have a refugee travel document reissued outside the Republic of Korea shall submit it to the Minister of Justice through the head of a diplomatic mission abroad. <Amended by Act No. 13539, Sep. 29, 2016, Act No. 16844, Dec. 24, 2019, Act No. 17448, Aug. 5, 2020>

제1항제2호 또는 제3호의 사유로 재발급신청을 하는 경우에는 신청서에 원래의 난민여행증명서를 첨부하여야 한다.

In the case of applying for reissuance for the grounds specified in paragraph ①, subparagraph 2 or 3, the original refugee travel document shall be attached to the application.

난민여행증명서의 재발급 및 교부 절차 등에 관하여는 제88조의6제2항을 준용한다. 다만, 신청인이 대한민국 밖에 있는 경우에는 재외공관의 장을 거쳐 신청인에게 교부하여야 한다. <개정 2016.9.29, 2022.8.16>

The procedures for reissuance and issuance of a refugee travel document shall be applied mutatis mutandis to Article 88-6(2). However, if the applicant is outside the Republic of Korea, it shall be delivered to the applicant through the head of a diplomatic mission abroad. <Amended by Act No. 13539, Sep. 29, 2016, Act No. 18537, Aug. 16, 2022>
