제90조 사실조사

권한 있는 공무원이 법 제80조제1항에 따라 사실조사를 한 결과 신고 또는 등록의 내용이 사실과 다른 것을 발견한 때에는 지체 없이 그 내용을 청장ㆍ사무소장 또는 출장소장에게 통보하여야 한다. <개정 2018.5.8, 2018.9.18>
When an authorized public official, as a result of a fact-finding investigation conducted pursuant to Article 80(1) of the Act, discovers that the contents of a report or registration differ from the facts, the official shall without delay notify the Commissioner General, the head of the office, or the head of the branch office of such contents. <Amended by May 8, 2018, Sep. 18, 2018>
출입국관리공무원은 법 제80조제2항에 따른 사실조사를 위하여 필요한 경우에는 「전자정부법」 제36조제1항에 따른 행정정보 공동이용을 통하여 다음 각 호의 서류를 조사할 수 있다. <신설 2018.9.18>
1. 법 제9조에 따른 사증발급인정서 발급 심사에 필요한 서류로서 법무부령으로 정하는 서류 중 신청인이 확인에 동의한 서류
2. 법 제20조, 제21조, 제24조 및 제25조에 따른 허가 심사 또는 법 제23조에 따른 체류자격 부여 심사에 필요한 서류로서 법무부령으로 정하는 서류 중 신청인이 확인에 동의한 서류
For the purpose of a fact-finding investigation pursuant to Article 80(2) of the Act, an immigration official may, if necessary, investigate the following documents through the joint use of administrative information pursuant to Article 36(1) of the 「Electronic Government Act」. <Newly Established by Sep. 18, 2018> 1. Documents prescribed by a Ministry of Justice Ordinance which are necessary for the screening for the issuance of a certificate of confirmation of visa issuance pursuant to Article 9 of the Act, among those to which the applicant has consented to verification. 2. Documents prescribed by a Ministry of Justice Ordinance which are necessary for the screening for a permit pursuant to Articles 20, 21, 24, and 25 of the Act, or for the screening for the granting of a status of stay pursuant to Article 23 of the Act, among those to which the applicant has consented to verification.
