①

법 제90조제4항에 따른 보증금 예치 절차에 관하여는 제17조제2항을 준용한다.

Regarding the procedure for depositing the guarantee deposit pursuant to Article 90(4) of the Act, Article 17(2) shall apply mutatis mutandis.

법 제90조제1항에 따른 신원보증인이 보증책임을 이행하지 아니한 때에는 같은 조 제4항에 따라 예치된 보증금을 같은 조 제2항에 따라 피보증외국인의 체류ㆍ보호 및 출국에 드는 비용으로 충당한다.

If a fidelity guarantor under Article 90(1) of the Act fails to fulfill his or her guarantee obligation, the guarantee deposit deposited pursuant to Article 90(4) of the Act shall be appropriated for the expenses incurred for the sojourn, protection, and departure of the guaranteed foreigner, pursuant to Article 90(2) of the Act.

법 제90조제4항에 따라 예치된 보증금은 신원보증인이 보증책임을 이행하거나 보증목적이 달성되었다고 인정될 때에는 신원보증인에게 반환하여야 한다.

The guarantee deposit deposited pursuant to Article 90(4) of the Act shall be returned to the fidelity guarantor when the fidelity guarantor fulfills his or her guarantee obligation or when it is acknowledged that the purpose of the guarantee has been achieved.
