법 제19조의5제3항에 따른 계절근로 전문기관(이하 "계절근로 전문기관"이라 한다)으로 지정받으려는 기관, 법인 또는 단체는 다음 각 호의 기준을 모두 갖추어야 한다.

1. 다음 각 목의 어느 하나에 해당할 것
1. 가. 「공공기관의 운영에 관한 법률」 제4조에 따라 지정된 공공기관
2. 나. 「농업협동조합법」에 따라 설립된 농업협동조합중앙회, 지역농업협동조합, 지역축산업협동조합, 품목별ㆍ업종별 협동조합, 조합공동사업법인 및 품목조합연합회
3. 다. 「민법」 제32조에 따라 설립된 비영리법인
4. 라. 「비영리민간단체 지원법」 제2조에 따른 비영리민간단체
5. 마. 「수산업협동조합법」에 따라 설립된 수산업협동조합중앙회, 지구별 수산업협동조합, 업종별 수산업협동조합 및 수산물가공 수산업협동조합
6. 바. 「지방자치단체 출자ㆍ출연 기관의 운영에 관한 법률」 제5조에 따라 지정된 출연기관
2. 다음 각 목의 요건을 모두 갖출 것
1. 가. 법 제19조의5제4항 각 호의 업무를 수행하기 위한 전문인력을 갖출 것
2. 나. 법 제19조의5제4항 각 호의 업무를 수행하기 위한 사무실(임차 또는 공동사용하는 경우에는 그 사용권을 말한다)을 갖출 것
3. 다. 그 밖에 법 제19조의5제4항 각 호의 업무 수행에 관하여 법무부장관이 필요하다고 인정하여 고시하는 요건을 갖출 것

Institutions, corporations, or organizations that intend to be designated as seasonal work specialist institutions (hereinafter referred to as "seasonal work specialist institutions") under Article 19-5(3) of the Act shall meet all of the following criteria. 1. Shall fall under any of the following categories: a. Public institutions designated under Article 4 of the Act on the Management of Public Institutions b. National Agricultural Cooperative Federation, regional agricultural cooperatives, regional livestock cooperatives, commodity-specific or industry-specific cooperatives, joint business corporations of cooperatives, and commodity cooperative federations established under the Agricultural Cooperatives Act c. Non-profit corporations established under Article 32 of the Civil Act d. Non-profit private organizations under Article 2 of the Act on Support for Non-profit Private Organizations e. National Federation of Fisheries Cooperatives, district fisheries cooperatives, industry-specific fisheries cooperatives, and seafood processing fisheries cooperatives established under the Fisheries Cooperatives Act f. Invested institutions designated under Article 5 of the Act on the Operation of Local Government Invested and Funded Institutions 2. Shall meet all of the following requirements: a. Possess specialized personnel to perform the duties specified in the subparagraphs of Article 19-5(4) of the Act b. Possess office space (in the case of leased or jointly used space, it refers to the right to use such space) to perform the duties specified in the subparagraphs of Article 19-5(4) of the Act c. Meet other requirements deemed necessary by the Minister of Justice and publicly announced for the performance of the duties specified in the subparagraphs of Article 19-5(4) of the Act

계절근로 전문기관으로 지정받으려는 기관, 법인 또는 단체는 별지 제33호의2서식의 계절근로 전문기관 지정신청서에 다음 각 호의 서류를 첨부하여 법무부장관에게 제출해야 한다.

1. 정관 또는 이에 준하는 사업 운영 규정
2. 계절근로 전문기관 운영계획서
3. 제1항제2호 각 목의 요건을 갖추었음을 증명하는 서류

Institutions, corporations, or organizations that intend to be designated as seasonal work specialist institutions shall submit an application for designation as a seasonal work specialist institution, in the form of Form No. 33-2, to the Minister of Justice, attaching the following documents. 1. Articles of incorporation or equivalent business operation regulations 2. Seasonal work specialist institution operational plan 3. Documents proving that the requirements specified in the items of subparagraph 2 of paragraph ① are met

제2항에 따라 지정신청서를 제출받은 법무부장관은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 법인 등기사항증명서(법인인 경우만 해당한다) 또는 사업자등록증명(주민등록번호가 제외된 사업자등록증명을 말한다)을 확인해야 한다. 다만, 신청인이 사업자등록증명의 확인에 동의하지 않는 경우에는 해당 서류를 첨부하도록 해야 한다.

Upon receiving an application for designation under paragraph ②, the Minister of Justice shall verify the corporate registration certificate (only for corporations) or the business registration certificate (referring to the business registration certificate excluding resident registration numbers) through the joint use of administrative information under Article 36(1) of the 「Electronic Government Act」. However, if the applicant does not consent to the verification of the business registration certificate, they shall attach the relevant document.

법무부장관은 제2항에 따라 지정신청을 받은 때에는 다음 각 호의 사항을 고려하여 지정 여부를 결정해야 한다.

1. 제1항의 지정기준에 적합한지 여부
2. 계절근로 전문기관 운영계획서의 충실성 및 실행 가능성
3. 재정 건전성

When the Minister of Justice receives an application for designation under paragraph ②, they shall decide whether to designate the applicant by considering the following matters. 1. Whether it complies with the designation standards in paragraph ① 2. The thoroughness and feasibility of the seasonal work specialist institution operational plan 3. Financial soundness

법무부장관은 법 제19조의5제3항에 따라 계절근로 전문기관을 지정한 경우에는 해당 기관, 법인 또는 단체에 별지 제33호의3서식의 계절근로 전문기관 지정서를 발급하고, 해당 사실을 법무부 홈페이지에 게시해야 한다.

If the Minister of Justice designates a seasonal work specialist institution under Article 19-5(3) of the Act, they shall issue a designation certificate for a seasonal work specialist institution, in the form of Form No. 33-3, to the designated institution, corporation, or organization, and post the fact of designation on the website of the Ministry of Justice.

법 제19조의5제3항에 따라 계절근로 전문기관으로 지정받은 기관, 법인 또는 단체는 법무부장관에게 매년 1월 31일까지 해당 연도의 운영계획을 제출해야 하며, 해당 연도의 운영실적은 다음 연도의 1월 31일까지 제출해야 한다.

Institutions, corporations, or organizations designated as seasonal work specialist institutions under Article 19-5(3) of the Act shall submit their operational plan for the current year to the Minister of Justice by January 31 of each year, and their operational results for the current year shall be submitted by January 31 of the following year.

제1항부터 제6항까지에서 규정한 사항 외에 계절근로 전문기관의 지정기준 및 지정 절차 등에 필요한 세부 사항은 법무부장관이 정하여 고시한다.

Detailed matters concerning the designation standards and procedures for seasonal work specialist institutions, other than those prescribed in paragraphs ① to ⑥, shall be determined and publicly announced by the Minister of Justice.
