제58조 보호명령서등 발부대장

①

청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 법 제51조제1항 또는 영 제78조제1항에 따라 보호명령서를 발부하는 때에는 보호명령서 발부대장에 이를 기재하여야 한다. <개정 2018.5.15, 2025.5.30>

When issuing a protection order under Article 51 (1) of the Act or Article 78 (1) of the Enforcement Decree, the head of the immigration office, the head of the office, the head of the branch office, or the head of the protection facility shall record it in the register of issuance of protection orders. <Amended by Presidential Decree No. 28836, May 15, 2018; No. 30828, May 30, 2025>

출입국관리공무원은 다음 각 호의 경우에는 보호명령서 발부대장에 그 사실을 기재해야 한다. <개정 2025.5.30>

  1. 1. 영 제65조제1항에 따라 보호기간 연장허가서를 발급받은 경우

  2. 2. 영 제68조에 따라 보호통지서를 송부한 경우

  3. 3. 법 제54조제1항 단서에 따라 보호통지서를 송부하지 않은 경우

  4. 4. 제60조에 따라 보호사항 변경통지서를 송부한 경우

  5. 5. 영 제78조제5항에 따라 보호기간 연장서가 발급된 경우

  6. 6. 보호를 해제(보호의 일시해제를 포함한다)한 경우

Immigration control officials shall record the following facts in the register of issuance of protection orders: <Amended by Presidential Decree No. 30828, May 30, 2025> 1. When a permit for extension of the protection period is issued under Article 65 (1) of the Enforcement Decree 2. When a notice of protection is sent under Article 68 of the Enforcement Decree 3. When a notice of protection is not sent under the proviso to Article 54 (1) of the Act 4. When a notice of change of protection details is sent under Article 60 5. When a permit for extension of the protection period is issued under Article 78 (5) of the Enforcement Decree 6. When protection is released (including temporary release from protection)

출입국관리공무원은 법 제51조제4항에 따라 긴급보호서를 발부하는 때에는 긴급보호서발부대장에 이를 기재하여야 한다. <개정 2010.11.16>

When issuing an emergency protection order under Article 51 (4) of the Act, immigration control officials shall record it in the register of issuance of emergency protection orders. <Amended by Presidential Decree No. 24773, Nov. 16, 2010>
