제69조의3 숙박외국인에 대한 자료 제출 절차ㆍ방법 등

법 제81조의3제1항 각 호 외의 부분에 따른 숙박업자(이하 "숙박업자"라 한다)는 같은 항 각 호 외의 부분에 따른 숙박외국인(이하 "숙박외국인"이라 한다)이 제공한 여권, 여행증명서 또는 외국인입국허가서의 사본(이하 "숙박외국인 관련 자료"라 한다)을 같은 조 제2항 본문에 따라 법무부장관이 설치ㆍ운영하는 정보통신망(이하 "숙박 정보통신망"이라 한다)을 통해 숙박업자의 소재지를 관할하는 청장ㆍ사무소장 또는 출장소장에게 제출해야 한다. <개정 2023.12.14>
A lodging business operator (hereinafter referred to as "lodging business operator") under the main clause of Article 81-3(1) of the Act shall submit copies of passports, travel certificates, or certificates of permission for alien entry (hereinafter referred to as "data related to foreigners staying in accommodation facilities") provided by foreigners staying in accommodation facilities (hereinafter referred to as "foreigners staying in accommodation facilities") under the main clause of the same paragraph, through the information and communication network installed and operated by the Minister of Justice (hereinafter referred to as the "accommodation information and communication network") under the main clause of Article 81-3(2) of the Act, to the head of the regional immigration office, branch office, or sub-branch office having jurisdiction over the location of the lodging business operator. <Amended by 2023.12.14>
숙박업자는 제1항에 따라 숙박외국인 관련 자료를 제출하려는 경우 숙박 정보통신망에 사용자 등록을 하고, 숙박외국인 관련 자료를 제출할 때마다 「전자서명법」 제2조제2호에 따른 전자서명 관련 정보를 함께 송신해야 한다.
When a lodging business operator intends to submit data related to foreigners staying in accommodation facilities under paragraph ①, the lodging business operator shall register as a user on the accommodation information and communication network and shall transmit electronic signature-related information as defined in Article 2(2) of the Electronic Signature Act together each time the data related to foreigners staying in accommodation facilities is submitted.
숙박업자는 법 제81조의3제2항 단서에 따라 다음 각 호의 어느 하나에 해당하는 경우에는 전자우편ㆍ팩스ㆍ문자전송 또는 전화를 이용하거나 직접 방문하여 숙박업자의 소재지를 관할하는 청장ㆍ사무소장 또는 출장소장에게 숙박외국인 관련 자료를 제출해야 한다.
1. 화재, 정전, 정보통신망의 장애, 컴퓨터 또는 관련 장치의 장애 등으로 숙박 정보통신망을 정상적으로 이용하는 것이 불가능하다고 법무부장관이 인정하는 경우
2. 법무부장관이 숙박 정보통신망 점검 등의 사유로 숙박 정보통신망 이용이 불가능하다고 공고한 경우
A lodging business operator shall submit data related to foreigners staying in accommodation facilities to the head of the regional immigration office, branch office, or sub-branch office having jurisdiction over the location of the lodging business operator by using electronic mail, facsimile, text message, telephone, or by visiting in person, in any of the following cases, pursuant to the proviso of Article 81-3(2) of the Act: 1. When the Minister of Justice recognizes that it is impossible to normally use the accommodation information and communication network due to fire, power outage, failure of the information and communication network, failure of computers or related devices, etc. 2. When the Minister of Justice announces that the use of the accommodation information and communication network is impossible for reasons such as inspection of the accommodation information and communication network.
제1항부터 제3항까지에서 규정한 사항 외에 숙박외국인 관련 자료의 제출 절차 및 방법에 관하여 필요한 사항은 숙박업자의 업종별 특성, 정보통신망의 이용 환경 등을 고려하여 법무부장관이 정한다.
Matters necessary for the procedures and methods of submitting data related to foreigners staying in accommodation facilities, other than those prescribed in paragraphs ① through ③, shall be determined by the Minister of Justice, taking into consideration the characteristics of each type of lodging business, the environment for using the information and communication network, etc.
