Article 75-3 (Verification of Authenticity of Alien Registration Card)
제75조의3 외국인등록증의 진위확인

법 제88조의4제1항에 따라 외국인등록증의 진위 여부에 대한 확인을 요청할 수 있는 사유는 다음 각 호와 같다.
1. 국가, 지방자치단체 또는 「공공기관 운영에 관한 법률」에 따른 공공기관이 공무상 외국인등록증 진위 확인이 필요한 경우
2. 「금융실명거래 및 비밀보장에 관한 법률」 제2조제1호의 금융회사등이 거래자의 실지명의 확인을 위해 외국인등록증 진위 확인이 필요한 경우
3. 「전기통신사업법」 제2조제8호의 전기통신사업자가 계약상대방이 본인임을 확인하기 위해 외국인등록증 진위 확인이 필요한 경우
The grounds for requesting verification of the authenticity of an alien registration card pursuant to Article 88-4(1) of the Act shall be as follows. 1. When a national government, local government, or public institution under the 「Act on the Management of Public Institutions」 requires verification of the authenticity of an alien registration card for official duties. 2. When a financial company, etc. under Article 2(1) of the 「Act on Real Name Financial Transactions and Secrecy」 requires verification of the authenticity of an alien registration card to confirm the real name of a transactor. 3. When a telecommunications service provider under Article 2(8) of the 「Telecommunications Business Act」 requires verification of the authenticity of an alien registration card to confirm that the contract counterparty is the person himself or herself.
법 제88조의4제1항에 따라 외국인등록증의 진위 여부에 대한 확인을 요청하려는 자는 별지 제139호의7서식의 외국인등록증의 진위 확인 신청서를 작성해 법무부장관에게 신청해야 한다.
A person intending to request verification of the authenticity of an alien registration card pursuant to Article 88-4(1) of the Act shall complete an application for verification of the authenticity of an alien registration card in Form No. 139-7 of the attached forms and submit it to the Minister of Justice.
제2항에 따른 확인요청을 받은 법무부장관은 외국인등록증 진위 확인의 요청 내용을 검토한 후 외국인등록증의 진위 확인이 필요하지 않다고 인정되는 경우에는 이를 확인해 주지 않을 수 있다.
Upon receiving a request for verification under paragraph ②, the Minister of Justice may, after reviewing the content of the request for verification of the authenticity of the alien registration card, refuse to provide verification if it is deemed unnecessary.
제1항부터 제3항까지에서 규정한 내용 외에 외국인등록증 진위 확인에 필요한 사항은 법무부장관이 정한다.
Matters necessary for the verification of the authenticity of an alien registration card, other than those prescribed in paragraphs ① to ③, shall be determined by the Minister of Justice.
