①
범칙금의 양정기준(量定基準)은 법무부령으로 정한다.
The standards for determining the amount of a penalty surcharge shall be prescribed by Ordinances of the Minister of Justice.
②
법무부장관은 출입국사범의 나이와 환경, 법 위반의 동기와 결과, 범칙금 부담능력, 그 밖의 정상을 고려하여 제102조제1항에 따른 통고처분을 면제할 수 있다.
The Minister of Justice may exempt a person from the notice disposition under Article 102 (1) after considering the age and circumstances of the immigration offender, the motive and result of the violation, the ability to pay the penalty surcharge, and other relevant factors.
