제13조 조건부 입국허가

지방출입국ㆍ외국인관서의 장은 다음 각 호의 어느 하나에 해당하는 외국인에 대하여는 대통령령으로 정하는 바에 따라 조건부 입국을 허가할 수 있다. <개정 2014.3.18>
1. 부득이한 사유로 제12조제3항제1호의 요건을 갖추지 못하였으나 일정 기간 내에 그 요건을 갖출 수 있다고 인정되는 사람
2. 제11조제1항 각 호의 어느 하나에 해당된다고 의심되거나 제12조제3항제2호의 요건을 갖추지 못하였다고 의심되어 특별히 심사할 필요가 있다고 인정되는 사람
3. 제1호 및 제2호에서 규정한 사람 외에 지방출입국ㆍ외국인관서의 장이 조건부 입국을 허가할 필요가 있다고 인정되는 사람
The head of a regional immigration office may grant a conditional admission permit to a foreigner who falls under any of the following subparagraphs, in accordance with the Presidential Decree. <Amended by Act No. 12417, Mar. 18, 2014> 1. A person who has not met the requirements of Article 12(3) subparagraph 1 for unavoidable reasons but is deemed able to meet such requirements within a certain period. 2. A person suspected of falling under any subparagraph of Article 11(1) or suspected of not meeting the requirements of Article 12(3) subparagraph 2, and who is deemed to require special examination. 3. A person, other than those prescribed in subparagraphs 1 and 2, whom the head of a regional immigration office deems it necessary to grant a conditional admission permit.
지방출입국ㆍ외국인관서의 장은 제1항에 따른 조건부 입국을 허가할 때에는 조건부입국허가서를 발급하여야 한다. 이 경우 그 허가서에는 주거의 제한, 출석요구에 따를 의무 및 그 밖에 필요한 조건을 붙여야 하며, 필요하다고 인정할 때에는 1천만원 이하의 보증금을 예치(預置)하게 할 수 있다. <개정 2014.3.18>
When granting a conditional admission permit under paragraph ①, the head of a regional immigration office shall issue a conditional admission permit. In this case, the permit shall be accompanied by restrictions on residence, an obligation to comply with summons, and other necessary conditions, and a deposit of not exceeding ten million won may be required if deemed necessary. <Amended by Act No. 12417, Mar. 18, 2014>
지방출입국ㆍ외국인관서의 장은 제1항에 따른 조건부 입국허가를 받은 외국인이 그 조건을 위반하였을 때에는 그 예치된 보증금의 전부 또는 일부를 국고(國庫)에 귀속시킬 수 있다. <개정 2014.3.18>
If a foreigner granted a conditional admission permit under paragraph ① violates the conditions, the head of a regional immigration office may forfeit all or part of the deposited guarantee to the National Treasury. <Amended by Act No. 12417, Mar. 18, 2014>
제2항과 제3항에 따른 보증금의 예치 및 반환과 국고귀속 절차는 대통령령으로 정한다.
The procedures for depositing and returning the guarantee and for its forfeiture to the National Treasury under paragraphs ② and ③ shall be prescribed by Presidential Decree.
