Article 16-2 (Temporary Landing Permission for Refugees)

지방출입국ㆍ외국인관서의 장은 선박등에 타고 있는 외국인이 「난민법」 제2조제1호에 규정된 이유나 그 밖에 이에 준하는 이유로 그 생명ㆍ신체 또는 신체의 자유를 침해받을 공포가 있는 영역에서 도피하여 곧바로 대한민국에 비호(庇護)를 신청하는 경우 그 외국인을 상륙시킬 만한 상당한 이유가 있다고 인정되면 법무부장관의 승인을 받아 90일의 범위에서 난민 임시상륙허가를 할 수 있다. 이 경우 법무부장관은 외교부장관과 협의하여야 한다. <개정 2012.2.10, 2013.3.23, 2014.3.18>
The head of a regional immigration and foreign affairs office may, upon recognizing there are reasonable grounds to allow landing, grant temporary landing permission for refugees for a period not exceeding 90 days, with the approval of the Minister of Justice, in cases where a foreigner on board a vessel, etc. has fled from an area where there is a fear of having their life, body, or freedom of body violated for reasons prescribed in Article 2, Item 1 of the 「Refugee Act」 or other similar reasons, and immediately applies for asylum in the Republic of Korea. 제1항의 경우에는 제14조제3항 및 제5항을 준용한다. 이 경우 "승무원 상륙허가서"는 "난민 임시상륙허가서"로, "승무원 상륙허가"는 "난민 임시상륙허가"로 본다.
In the case of paragraph ①, Article 14, paragraphs 3 and 5 shall apply mutatis mutandis. In this case, 'Crew Landing Permit' shall be deemed 'Temporary Landing Permit for Refugees' and 'Crew Landing Permission' shall be deemed 'Temporary Landing Permission for Refugees'.
제1항에 따라 비호를 신청한 외국인의 지문 및 얼굴에 관한 정보의 제공 등에 관하여는 제12조의2를 준용한다.
With regard to the provision of information on fingerprints and facial features of a foreigner who has applied for asylum under paragraph ①, Article 12-2 shall apply mutatis mutandis.
