제36조 체류지 변경의 신고

제31조에 따라 등록을 한 외국인이 체류지를 변경하였을 때에는 대통령령으로 정하는 바에 따라 전입한 날부터 15일 이내에 새로운 체류지의 시ㆍ군ㆍ구 또는 읍ㆍ면ㆍ동의 장이나 그 체류지를 관할하는 지방출입국ㆍ외국인관서의 장에게 전입신고를 하여야 한다. <개정 2014.3.18, 2016.3.29, 2018.3.20, 2020.6.9>
Where a foreigner registered under Article 31 changes his or her place of residence, he or she shall report the change of residence to the head of the relevant Si/Gun/Gu or Eup/Myeon/Dong, or the head of the competent immigration office and branch office within 15 days from the date of moving in, as prescribed by Presidential Decree. <amended 2014.3.18, 2016.3.29, 2018.3.20, 2020.6.9>
외국인이 제1항에 따른 신고를 할 때에는 외국인등록증을 제출하여야 한다. 이 경우 시ㆍ군ㆍ구 또는 읍ㆍ면ㆍ동의 장이나 지방출입국ㆍ외국인관서의 장은 그 외국인등록증에 체류지 변경사항을 적은 후 돌려주어야 한다. <개정 2014.3.18, 2016.3.29>
When a foreigner makes a report under paragraph ①, he or she shall submit the alien registration card. In this case, the head of the relevant Si/Gun/Gu or Eup/Myeon/Dong, or the head of the immigration office and branch office shall inscribe the change of residence on the alien registration card and return it. <amended 2014.3.18, 2016.3.29>
제1항에 따라 전입신고를 받은 지방출입국ㆍ외국인관서의 장은 지체 없이 새로운 체류지의 시ㆍ군ㆍ구 또는 읍ㆍ면ㆍ동의 장에게 체류지 변경 사실을 통보하여야 한다. <개정 2014.3.18, 2016.3.29>
Where the head of an immigration office and branch office receives a report of change of residence under paragraph ①, he or she shall promptly notify the head of the relevant Si/Gun/Gu or Eup/Myeon/Dong of the change of residence. <amended 2014.3.18, 2016.3.29>
제1항에 따라 직접 전입신고를 받거나 제3항에 따라 지방출입국ㆍ외국인관서의 장으로부터 체류지 변경통보를 받은 시ㆍ군ㆍ구 또는 읍ㆍ면ㆍ동의 장은 지체 없이 종전 체류지의 시ㆍ군ㆍ구 또는 읍ㆍ면ㆍ동의 장에게 체류지 변경신고서 사본을 첨부하여 외국인등록표의 이송을 요청하여야 한다. <개정 2014.3.18, 2016.3.29>
Where the head of a Si/Gun/Gu or Eup/Myeon/Dong receives a report of change of residence directly under paragraph ① or receives notification of a change of residence from the head of an immigration office and branch office under paragraph ③, he or she shall promptly request the transfer of the alien registration card from the head of the Si/Gun/Gu or Eup/Myeon/Dong of the former place of residence, attaching a copy of the report of change of residence. <amended 2014.3.18, 2016.3.29>
제4항에 따라 외국인등록표 이송을 요청받은 종전 체류지의 시ㆍ군ㆍ구 또는 읍ㆍ면ㆍ동의 장은 이송을 요청받은 날부터 3일 이내에 새로운 체류지의 시ㆍ군ㆍ구 또는 읍ㆍ면ㆍ동의 장에게 외국인등록표를 이송하여야 한다. <개정 2016.3.29>
Where the head of a Si/Gun/Gu or Eup/Myeon/Dong of the former place of residence receives a request for the transfer of an alien registration card under paragraph ④, he or she shall transfer the alien registration card to the head of the Si/Gun/Gu or Eup/Myeon/Dong of the new place of residence within 3 days from the date of receiving the request for transfer. <amended 2016.3.29>
제5항에 따라 외국인등록표를 이송받은 시ㆍ군ㆍ구 또는 읍ㆍ면ㆍ동의 장은 신고인의 외국인등록표를 정리하고 제34조제2항에 따라 관리하여야 한다. <개정 2016.3.29>
Where the head of a Si/Gun/Gu or Eup/Myeon/Dong receives the transfer of an alien registration card under paragraph ⑤, he or she shall organize the alien registration card of the reporting person and manage it in accordance with Article 34 (2). <amended 2016.3.29>
제1항에 따라 전입신고를 받은 시ㆍ군ㆍ구 또는 읍ㆍ면ㆍ동의 장이나 지방출입국ㆍ외국인관서의 장은 대통령령으로 정하는 바에 따라 그 사실을 지체 없이 종전 체류지를 관할하는 지방출입국ㆍ외국인관서의 장에게 통보하여야 한다. <개정 2014.3.18, 2016.3.29>
Where the head of a Si/Gun/Gu or Eup/Myeon/Dong or the head of an immigration office and branch office receives a report of change of residence under paragraph ①, he or she shall promptly notify the head of the immigration office and branch office having jurisdiction over the former place of residence, as prescribed by Presidential Decree. <amended 2014.3.18, 2016.3.29>
제2항에도 불구하고 제33조제6항에 따라 모바일외국인등록증을 발급받은 자가 「민원 처리에 관한 법률」 제12조의2에 따라 전자민원창구를 이용하는 경우에는 체류지 변경사항을 모바일외국인등록증에 수록하는 것으로 제2항 후단에 따라 외국인등록증에 위 사항을 기재하는 것을 갈음할 수 있다. <신설 2023.6.13>
Notwithstanding paragraph ②, where a person who has been issued a mobile alien registration card under Article 33 (6) uses an electronic civil petition window in accordance with Article 12-2 of the 「Act on the Processing of Civil Petitions」, the inscription of the change of residence on the mobile alien registration card may substitute for the inscription of the said matters on the alien registration card under the latter part of paragraph ②. <newly inserted 2023.6.13>
