Article 4-5 (Objection to Decision on Prohibition of Departure, etc.)
제4조의5 출국금지결정 등에 대한 이의신청

제4조제1항 또는 제2항에 따라 출국이 금지되거나 제4조의2제1항에 따라 출국금지기간이 연장된 사람은 출국금지결정이나 출국금지기간 연장의 통지를 받은 날 또는 그 사실을 안 날부터 10일 이내에 법무부장관에게 출국금지결정이나 출국금지기간 연장결정에 대한 이의를 신청할 수 있다. <개정 2011.7.18>
A person whose departure is prohibited under Article 4(1) or (2), or whose period of prohibition of departure is extended under Article 4-2(1), may file an objection to the decision on prohibition of departure or the decision on extension of the period of prohibition of departure with the Minister of Justice within 10 days from the date of receiving notice of the decision on prohibition of departure or the extension of the period of prohibition of departure, or from the date of becoming aware of such fact. <Amended by Act No. 10922, Jul. 18, 2011>
법무부장관은 제1항에 따른 이의신청을 받으면 그 날부터 15일 이내에 이의신청의 타당성 여부를 결정하여야 한다. 다만, 부득이한 사유가 있으면 15일의 범위에서 한 차례만 그 기간을 연장할 수 있다.
Upon receiving an objection under paragraph (1), the Minister of Justice shall decide whether the objection is valid within 15 days from the date of receipt. Provided, that if there are unavoidable grounds, the period may be extended once within the scope of 15 days.
법무부장관은 제1항에 따른 이의신청이 이유 있다고 판단하면 즉시 출국금지를 해제하거나 출국금지기간의 연장을 철회하여야 하고, 그 이의신청이 이유 없다고 판단하면 이를 기각하고 당사자에게 그 사유를 서면에 적어 통보하여야 한다.
If the Minister of Justice determines that the objection under paragraph (1) is justified, the Minister shall immediately lift the prohibition of departure or withdraw the extension of the period of prohibition of departure. If the Minister determines that the objection is not justified, the Minister shall dismiss it and notify the party in writing of the grounds for dismissal.
