제66조의12 심의ㆍ의결 등

외국인보호위원회는 제66조의5 각 호의 사항에 대하여 심의ㆍ의결한다.
The Foreigner Protection Committee shall deliberate and resolve matters listed in each subparagraph of Article 66-5.
외국인보호위원회는 제1항에 따른 심의ㆍ의결에 필요하다고 인정하면 피보호자와 그 밖의 관계인에 대하여 진술을 듣거나 필요한 사실을 조사할 수 있다.
If deemed necessary for the deliberation and resolution under paragraph ①, the Foreigner Protection Committee may hear statements from the protected person and other related persons, or investigate necessary facts.
외국인보호위원회는 제1항에 따른 심의ㆍ의결에 필요하다고 인정하면 피보호자, 관계인, 관계 기관 또는 단체에 관련 자료의 제출을 요청할 수 있다. 이 경우 요청을 받은 사람, 관계 기관 또는 단체는 정당한 사유가 없으면 이에 따라야 한다.
If deemed necessary for the deliberation and resolution under paragraph ①, the Foreigner Protection Committee may request the submission of relevant data from the protected person, related persons, or relevant agencies or organizations. In this case, the person, relevant agency, or organization that received the request shall comply, unless there is a justifiable reason not to.
외국인보호위원회의 심리는 구술심리나 서면심리로 한다. 다만, 당사자가 구술심리를 신청한 경우에는 서면심리만으로 결정할 수 있다고 인정되는 경우 외에는 구술심리를 하여야 한다.
The deliberation of the Foreigner Protection Committee shall be conducted through oral or written deliberation. However, if the parties request oral deliberation, oral deliberation shall be conducted unless it is recognized that a decision can be made solely through written deliberation.
외국인보호위원회는 제4항 단서에 따라 구술심리 신청을 받으면 그 허가 여부를 결정하여 신청인에게 알려야 한다.
Upon receiving a request for oral deliberation pursuant to the proviso of paragraph ④, the Foreigner Protection Committee shall decide whether to grant the request and notify the applicant.
제5항의 통지는 서면으로 하거나 전화, 휴대전화를 이용한 문자전송, 팩시밀리 또는 전자우편 등 간편한 방법으로 할 수 있다.
The notification under paragraph ⑤ may be made in writing or by simple methods such as phone, text message via mobile phone, facsimile, or electronic mail.
외국인보호위원회의 구술심리에 출석한 피보호자는 변호사의 조력을 받을 권리가 있고, 본인과 신뢰관계에 있는 사람의 동석을 신청할 수 있다.
A protected person attending an oral deliberation of the Foreigner Protection Committee has the right to receive assistance from a lawyer and may request the attendance of a person with whom they have a relationship of trust.
